Heard Shri Awadhesh Kumar Mishra, learned counsel for the petitioner and Shri Jitendra Singh, learned Additional Chief Standing Counsel on behalf of State-respondents.

Shri Jitendra Singh, learned A.C.S.C has raised a preliminary objection that the remedy of the petitioner is by applying for scrutiny of the aforesaid paper under Chapter XII, Regulation 21(e) of Part II-B of the U.P. Intermediate Education Act, 1921.

In view of the aforesaid, learned counsel for the petitioner submits that he may be permitted to withdraw the present writ petition, at this stage, with liberty to apply for scrutiny as provided under the Act, 1921.

Accordingly, the writ petition is dismissed as withdrawn, at this stage, with the aforesaid liberty.
