Heard learned counsel for the parties.

The present writ petition has been filed with the following prayer:-

"Issue a writ order or direction in the nature of mandamus commanding and directing the respondents no.2 to produce the copy of subject Mathematics (Intermediate0 of the year 2026 before this Hon'ble Court."

Learned counsel for the petitioner has submitted that the petitioner appeared in the Intermediate Examination in the Science group and secured 361 marks out of 500. He further submitted that in other subjects, the petitioner passed with distinction, securing the following marks in Science subjects: Physics – 73, Chemistry – 92; and in other subjects, Hindi – 88 and English – 75. However, in the subject of Mathematics, he was awarded only 33 marks, whereas, in all probability, he was expected to secure more than 80 marks. It is therefore submitted that the marks awarded in Mathematics, i.e., 33, are likely erroneous. He has further submitted that he appeared in the Joint Entrance Examination (J.E. – Mains) – 2026 (B.E./B.Tech) in the General category, for which the total marks required in the Intermediate Examination is 75%. However, due to the aforementioned error, his percentage has been recorded as 72%.

In view of the aforesaid, he submits that the copy of the subject mathematics Intermediate for the year 2026 may be summoned and some expert may be directed to evaluate the same.

Learned Standing Counsel has submitted Chapter 12 Regulation 21(ङ) of the Intermediate Education Act, 2021 governs the field and which is reproduced herein below:

21. हाईस्कूल तथा इण्टरमीिडएट के परीक्षाथीर् जो अपनी उत्तर पुस्तकें सिन्नरीक्षा कराना चाहते हैं, िनम्निलिखत िनयमों के अनुसार करा सकते हैं- ( ङ) सिन्नरीक्षा का तात्पयर् उत्तर पुस्तकों का पुनमूर्ल्यांकन नहीं है, सिन्नरीक्षा कायर् में परीक्षािथयों की उत्तर पुस्तकों में यह देखा जायेगा िक परीक्षाथीर् की उत्तर-पुस्तक में क्या अलग-अलग प्रश्नों में िदये गये अंकों का योग करने उन्हें अग्रेनीत करने अथवा िकसी प्रश्न अथवा उसके भाग पर अंक देना छूटने की कोई त्रुिट तो नहीं हुई है। सिन्त् र ीक्षा कायर् में परीक्षािथयों की उत्तर पुस्तकों में परीक्षक द्वारा मूल्यािकत प्रश्नों के उत्तरों का पुनमूर्ल्यांकन नहीं िकया जायेगा।

He has further submitted that there are provisions for the scrutiny of marks in the answer sheet, and in case the petitioner applies for the same, it shall be conducted.

At this juncture, the petitioner submits that the last date for submission of the form is 10th May, 2026.

In view of the aforesaid and considering the future of the student, this Court deems it appropriate to exercise its extraordinary powers under Article 226 of the Constitution of India and directs respondent No. 2 to arrange for the scrutiny of the Mathematics paper (Roll No. 2266003998) on or before 8th May, 2026.

Learned Standing Counsel is directed to communicate this order forthwith to Petitioner No. 2 for necessary compliance. The Registrar (Compliance) is also directed to communicate this order forthwith for necessary compliance.
