Heard Shri S.P. Singh Somvanshi, the learned counsel for the petitioner, Shri Vikas Rai, the learned Standing Counsel for the State of U.P. and Shri D.P.S. Chauhan, the learned counsel for the opposite party Nos.2 and 3- Mahayogi Guru Gorakhnath Ayush University, Gorakhpur.

By means of the instant petition filed under Article 226 of the Constitution of India, the petitioner has sought issuance of a direction to the opposite party Nos.2 and 3 to open the web-portal of the University to enable the petitioners to fill-up the form of Second Professional Course of B.A.M.S. for the session 2022-23.

It has been stated in the writ petition that the petitioners had admitted to B.A.M.S. Programme in the year 2022-23. They were not permitted to appear in the first Professional Examination on the ground that they had not attended at least 75% of the classes. The petitioners are seeking permission to take the First Professional Examination along with other students of their batch as they claim that hey have attended extra classes and have removed the shortcomings of less attendance.

On the basis of written instructions provided by the Examination Controller of Mahayogi Guru Gorakhnath Ayush University, Gorakhpur, Shri Shri D.P.S. Chauhan has stated that the examination of First Professional Course of the batch in which the petitioners had taken admission, were conducted during the 19.04.2025 to 10.05.2025 and the examination results were declared on 12.10.2025. percentage off classes was declared in the month of May 2025. As per the provision contained in National Commission of Indian System of Medicine Act, 2020, the First Professional B.A.M.S. Course will be of 18 months, the Second Professional B.A.M.S. Course will be of 18 months and the third Professional B.A.M.S. Course will also be of equal duration.

It is stated in the instructions that the petitioners have not completed 18 months duration since May 2025 in the month of April 2025 when the examinations are scheduled to be held. Therefore, they are not eligible to participate in the examinations scheduled to be held in the month of April 2026. After they complete the duration of 18 months, they will be permitted to appear in the examinations that will be held thereafter, possibly in the months of November-December 2026.

Accordingly, the present petition is disposed off by providing that the petitioners will be permitted to participate in the first Professional B.A.M.S. Examination after they complete the duration of 18 months provided in National Commission of Indian System of Medicine Act, 2020.
