Supplementary affidavit as well as amendment application filed by counsel for the petitioners are taken on record.

This petition has been filed for the following relief:

"issue a suitable writ, order or direction in the nature of writ of mandamus directing the Sub Divisional Officer/Pargana Adhikari/Assistant Collector, Shikohabad to decide the application dated 29.1.2025 of the petitioners in Suit No. 4/9 of 1973 expeditiously and entering the name of the petitioners in light of confirmed order dated 1.5.1975 and the judgment of this hon'ble Court dated 19.11.2024."

Contention of learned counsel for the petitioners is that by order dated 19.11.2024 passed by this Court in Writ B No. 14568 of 1983, the appellate order passed in proceedings under Section 176 of the U.P.Z.A. & L.R. Act, 1950 dated 01.05.1975 has been confirmed. Despite the proceedings terminated in favour of the petitioner, they were not given effect to by the respondents.

An objection has been raised by learned Standing Counsel that the orders passed in proceedings under Section 176 of the U.P.Z.A. & L.R. Act, 1950 are decree and are executable as the provisions of C.P.C. are applicable. They are further executable under the provisions of U.P. Revenue Court Manual. He further submitted that power under Article 226 of the Constitution of India cannot be exercised for compliance of orders passed by revenue court in view of the judgment of Division Bench

of this Court in case of Manbhavati Vs. State of U.P. and others reported in 2020 1 AWC 789A.

In view of the same, I am not inclined to interfere in the matter.

Accordingly, the petition is disposed of with liberty to the petitioner to move an appropriate application for execution of the appellate decree passed in his favour. In case, such an application for execution is filed, the same shall be considered and decided by the court below expeditiously, preferably within a period of six months, in accordance with law.
