In pursuance of the last order dated 13.04.2026, the learned Standing Counsel on the basis of his instructions has submitted that National Council of Educational Research and Training has issued certain curriculum which provides for the medium of education to be in Hindi and accordingly the papers of D.El.Ed. has to be given in Hindi except for the paper English.

On a pointed query by the Court that whether there is any Statute, Rules and Regulations, which mandates such a medium for giving the examination in the D.El.Ed. course, he seeks time to bring on record the said Rules, Regulations along with curriculum which he seek to rely upon.

Per contra, learned counsel for the petitioner placing reliance on the decision of the Constitutional Bench of the Apex Court in the case of State of Karnataka and another vs. Associated Management of (Govt. Recognized Unaided English Medium) Primary and Secondary Schools and others, reported in 2014 (9) SCC 485 to contend that freedom of speech and expression will include, a right of a children to be educated in medium of his choice; and as such restriction cannot be put in a manner which exclude a teacher, who knows some other language than Hindi. It is further submitted that a child has a right to choose the medium of instruction, however, the question before the Court is whether a prospective teacher, who is required to pass D.El.Ed. course can be restricted to give the examination, only in Hindi medium and not in
