Heard learned counsel for the petitioners and Sri Ashwani Kumar Tripathi, learned Additional Chief Standing Counsel for the Staterespondents.

At the very outset, learned Additional Chief Standing Counsel submits that an FIR has been registered in the present matter regarding the alleged kidnapping of petitioner no.1, Pooja Yadav, being Case Crime No.0010 of 2026, under Section 87 of the BNS, at Police Station Chiluatal, District Gorakhpur, against one Chandraveer Singh.

Learned counsel for the petitioners, in response, submits that the aforesaid FIR has not been lodged against petitioner no.2 and, therefore, the present writ petition is maintainable. He accordingly seeks indulgence of this Court.

Learned Additional Chief Standing Counsel prays for time to obtain instructions as to whether petitioner no.2, Sujit Chauhan, has been made an accused in the aforesaid FIR during the course of investigation.

Put up this case on 30.01.2026 as fresh.
