2. Heard learned counsel for the petitioner, learned Standing Counsel for the State respondents and Shri Shailendra Singh Chauhan, learned counsel for the Nagar Nigam.

3. Petitioner alleges encroachment by respondent no.5 on public path. Shri Shailendra Singh Chauhan, learned counsel has written instructions stating, a survey was conducted yesterday itself and it was found that the property in question is an old abadi and there are no documents available in Nagar Nigam with regard to any public road having been built or existing in the said area. The alleged encroacher claims to have constructed a sewer chamber of his own resources on abadi land, therefore, in these circumstances it is not possible for Nagar Nigam to undertake any exercise for removal of encroachment. Instructions, as also the documents annexed with it, are taken on record.

4. The petitioner is at liberty to pursue other remedies, if he has a cause or locus standi which may include filing a representation before the Municipal Commissioner concerned and General Manager, Jalkal, Lucknow who can get the matter re-enquired, if necessary.

5. With the aforesaid liberty, the writ petition is disposed of.
