Mr. Arun Mishra, learned advocate appears on behalf of petitioner and submits, his client is entitled to have permanent disconnection of the electric supply. He draws attention to electricity bill dated 21st September, 2023. He demonstrates from the bill, as on 30th March, 2021 meter reading was 14940. On 21st September, 2023 meter reading was the same. Relying in clause 4.38 (i) (b) he submits, the line is to be disconnected. He seeks interference.

Mr. Narendra Kumar Tiwari, learned advocate appears on behalf of respondents (the electricity company). He draws attention to sub-clause (c) to submit, section 4.14 (g) is applicable. Sub clauses (b) and (c) underclause 4.38 (i) are reproduced below.

"(b) If the cause for which the supply was temporarily disconnected is not removed within six months period.

(c) On request of consumer as described under Section 4.14(g)."

Mr. Mishra replies, his client has invoked sub-clause (b). In other words sub-clause (c) is an independent sub-clause but not relied upon by his client.

Petitioner will be heard on his legal right to compel the supply company to do something it has not done as provided by enabling sub-clause (b). The supply company will be heard on whether permanent disconnection will militate against their claim for arrears on consumption charges remaining unpaid by petitioner.
