Heard Shri Ankit Kumar Pandey, learned counsel for the petitioner as well as learned Standing Counsel for respondents no. 1 and 2.

It has been submitted by learned counsel for the petitioner that the objections filed by opposite party no.3 before the Consolidation Officer was allowed and he has granted his share at Gata No. 724/1 and despite his grievance having been resolved at the stage of Consolidation Officer, he still preferred an appeal and subsequently a revision before the Deputy Director of Consolidation.

He has submitted that there are no occasion for opposite party no.3 to file the appeal and revision and the Deputy Director of Consolidation has allowed his revision on completely new set of facts which has never raised by the opposite party no.3 before any of the authorities below.
