Transfer order dated 01.11.2025 passed by the respondent No.2/Chief Medical Officer, District Kushi Nagar is under challenge by which the petitioner was transferred from Community Health Center Motichak Kushinagar to Community Health Center Turkha (Khadda) Kushinagar.

Following order was passed by this Court 02.04.2026 :-

1. The order of transfer dated 01.11.2025 passed by the Chief Medical Officer, Kushinagar/respondent No.2 is under challenge.

2. Though in the present petition, no interim protection was granted in favour of the petitioner but till date the petitioner has not joined this transfer post.

3. In this view of the matter, learned Standing Counsel is directed seek Instructions that what action has been taken against the petitioner for non-joining the transfer post and why the disciplinary proceedings would not be initiated against the petitioner. 4. List this matter again on 09.04.2026.

Pursuant to the aforesaid order, Instructions dated 07.04.2026 placed before the Court, the same is taken on record.

From perusal of the Instructions, it is clear that more than five months have been lapsed from the date of transfer but till today, the petitioner has

not joined his transfer place. Though specific direction has been given by this Court to initiate disciplinary proceedings against the petitioner but as per Instructions, the same could not be initiated due to pendency of the present petition.

Heard learned counsel for the parties and perused the record.

In the facts and circumstances of the case and taking a lenient view, the petitioner is granted a week's time to join his transferred post which will be subject to final outcome of this writ petition failing which the Appointing Authority of the petitioner is directed to place the petitioner under suspension and file affidavit in this regard on or before the next date of listing.

List this matter on 28.04.2026.

Registrar (Compliance) is directed to communicate a copy of this order to respondent No.2/Chief Medical Officer, District Kushi Nagar through C.J.M. Kushi Nagar forthwith.
