State of Uttar Pradesh & 4 others, decided January 27, 2026 — An Assistant Teacher challenged, by certiorari, the order dated 30.12.2025 of the Basic Shiksha Adhikari, Chitrakoot, along with the Government Order dated 14.11.2025 (issued through Circular letter dated 16.11.2025 of the Director of Education (Basic)) and the Office Order dated 29.12.2025 of the BSA, Chitrakoot, relating to transfer of teachers to maintain the students-teachers ratio, and sought restraint on interference with his working and regular monthly salary. The Court noted that, in pursuance of the order dated 23.05.2025, teachers had already been transferred and had joined on 01.07.2025; accordingly, there was no occasion for issuance of another Government Order dated 14.11.2025, whose issuance had resulted in a chaotic situation requiring the Court's interference. Heard learned counsel for the petitioner, Mr. Umesh Chandra Kesarwani, learned counsel for the respondent-BSA and learned Standing Counsel for the State-respondents.

The writ petition has been filed with the following prayers:-

"(a) Issue a writ, order or direction in the nature of certiorari quashing the order dated 30.12.2025 issued by the Basic Shiksha Adhikari, Chitrakoot.

(b) Issue a writ, order or direction in the nature of certiorari quashing the Government order dated 14.11.2025 issued by the State Government by Circular letter dated 16.11.2025 issued by the Director of Education (Basic) and the Office order dated 29.12.2025 issued by the Basic Shiksha Adhikari, Chitrakoot.

(c) Issue a writ, order or direction of suitable nature commanding the respondents not to interfere in the working of the petitioner as Assistant Teacher in the institution where the petitioner has been working prior to the issuance of the order dated 30.12.2025 and to pay the petitioner's regular monthly salary on such posts regularly every month."

The bunch of petitions dealing with the same issue has already been heard by this Court. This Court is of the considered opinion that, in pursuance of the order dated 23.05.2025, few teachers have already been transferred, pursuant to which they have joined on 01.07.2025.

Therefore there was no occasion for issuance of another Government Order dated 14.11.2025 for transferring number of teachers to maintain students teachers ratio. The issuance of the another Government Order has resulted in a chaotic situation, hence, in these circumstances, interference is required by this Court.

Let this matter be posted as fresh on 10.02.2026.

Till then, no coercive action shall be taken against the petitioner.
