Heard Shri Ghaus Beg, learned counsel for the petitioner and Shri Vinod Kumar Shukla for Respondents No.2 & 3.

This Court vide order dated 18.09.2024 had directed the Respondents No.2 & 3 to file supplementary counter affidavit giving categorical reply as to under what provisions of law the disciplinary proceedings can be continued against any employee of the Nagar Nigam after his retirement.

It appears that no supplementary counter affidavit has been filed. The matter was again listed on 27.09.2024 and this Court had passed the following order:

"Despite specific plea having been made from the opposite parties on 22nd July, 2024 and the subsequent order dated 18th September, 2024, the question as to whether civil service regulations have been adopted in the Nagar Nigam have been adopted or not are still unanswered.

In view of aforesaid, list on 3rd October, 2024 as fresh.

In case no such specific answer is made by the opposite parties, it may be assumed that the aforesaid regulations have not been adopted by the Nagar Nigam."
