Learned counsel for the petitioner submits that the petitioner being first wife of deceased Dilip Kumar Singh has been required to place succession certificate for payment of family pension and other dues of late Dilip Kumar Singh. He further submits that though in the order dated 02.11.2023 the fact regarding the petitioner being first legally wedded wife of the deceased Dilip Kumar Singh has been accepted, however, on the basis of two contradictory documents, the succession certificate has been acquired, which is not permitted in the relevant rules regarding payment of family pension. In support of his submissions, he has placed reliance upon the judgement passed in the case of Hafiz Naushad Ahmad and Another v. Union of India and 2 others, Writ-C No. 4585 of 2021 , decided on 16.03.2021.

To the aforesaid, Mr. Vansh Gopal Mishra, holding brief of Mr. Akhilesh Kumar Sharma, learned counsel for the BSA requests for ten days' time to obtain instructions in the matter.
