Allahabad High Court (Court No. 6, Prakash Padia, J.), Writ - A No. 4587 of 2026, Rajesh Kumar Singh v. State of U.P. and Another (order dated April 15, 2026): The petitioner, a Sub-Inspector in the U.P. Police stated to have been directed to join duties at Mau and to vacate his allotted residential Police Quarter at Kotwali Ghazipur, sought mandamus restraining dispossession of his family from the quarter. Nobody appeared for the petitioner on 02.04.2026 or in the revised list. By order dated 03.04.2026 (reproduced), noting that even the petitioner's representation dated 10.12.2025 to the SP, Ghazipur did not mention the date of transfer, the Court directed the SP, Ghazipur to take possession of the quarter from the petitioner and submit a report within a week, and directed the Registrar (Compliance) to communicate the order by 07.04.2026. On 15.04.2026 the learned Standing Counsel informed the Court that the order had been faxed to the SP on 06.04.2026; nevertheless no report or information was filed. After hearing counsel for the parties, following order was passed by this Court on 03.04.2026:

1. The matter was heard at great length on 02.04.2026 in the first call and thereafter on the request made by the counsel for the petitioner the matter was directed to be heard again in the revised list. Nobody is present on behalf of petitioner even in the revised list and then the matter was directed to be listed as fresh on 03.04.2026.

2. But today when the matter is taken up nobody is present even in the revised call.

3. The petitioner has preferred the present writ petition interalia with the following prayer:-

"(I) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent concern to not dispossess the family of petitioner from Residential house of Police Quarter at Kotwali Ghazipur."

4. It is stated in paragraph-9 of the writ petition that the petitioner is Sub-Inspector under U.P. Police. The petitioner was directed to join his duties at Mau and without assigning any cogent reasons he was directed to vacate the quarter allotted to him.

5. In this regard representation has been made by the petitioner before the Superintendent of Police, Ghazipur dated

writ petition.

6. Even in the said representation, the date of transfer has not been mentioned.

7. In this view of the matter, the Superintendent of Police, Ghazipur is directed to take the possession of the aforesaid house from the petitioner and submit its report within a week.

8. List this matter again on 15.04.2026.

9. The matter will be taken up at 10:00 a.m..

10. Registrar (Compliance) is directed to communicate the copy of this order to the Superintendent of Police, Ghazipur by 07.04.2026.

Today when the matter is taken up, it is informed by learned Standing Counsel that aforesaid order has been communicated his office to the Superintendent of Police, Ghazipur on 06.04.2026 by way of FAX, the letter in this regard placed before the court, the same is taken on record.

Despite proper information given to the Superintendent of Police, Ghazipur, he has no submitted any report nor given any information in this regard.

4 In this view of the matter, Superintendent of Police, Ghazipur is directed to appear before this Court on 24.04.2026 along with proper explanation in this regard.

List this matter on 24.04.2026. It is made clear that the matter will be taken up at 10:00 a.m. sharp.

Registrar (Compliance) is directed to communicate the copy of this order to the Superintendent of Police, Ghazipur through C.J.M. Ghazipur forthwith.
