Heard learned counsel for the petitioner and learned Standing Counsel.

On the request of learned State counsel, this court granted time on 02.04.2026 to file counter affidavit on the point that under what circumstances, the petitioner was not allowed to work in pursuance of the directions of the writ court.

Counter affidavit dated 08.4.2026 has been filed in the court today, the same is taken on record.

From the perusal of the affidavit, this Court could not find any reply to the specific query made by the court in paragraph No.4 of the order dated 02.4.2026. For ready reference, the Paragraph No.4 of the order dated 02.4.2026 is reproduced as hereinbelow :

" 4. Dr. Uday Veer Singh, learned Additional Chief Standing Counsel submits that during discharge of his duties, the petitioner's contract was terminated. However, he does not dispute the fact that earlier, termination order was set aside by the writ Court. He prays for some time to file counter affidavit on the point that under what circumstances, the petitioner was not allowed to work in pursuance of directions of the writ Court."

In compliance of order dated 02.04.2026, the Deputy Commissioner, Urban Employment, Hardoi, who sworn the affidavit is present today in the Court along with the instructions. The copy of the said instructions dated 06.04.2026 is taken on record.

On being asked that why reply to the specific query made by the court, has

not been given by him in the said counter affidavit. He could not give any satisfactory explanation to the same.

Sri Pankaj Patel, learned counsel for the State -opposite party prays for and is allowed two weeks' time to file a better affidavit.

On the next date fixed, the Standing Counsel shall produce the record, as was required by the court vide the earlier order.
