Heard learned counsel for the petitioner, Mr. Syed Aftab Ahmad, learned counsel for the respondent no. 2 to 5 and Mr. Dr. Udai Veer Singh for respondent no.1

The present petition has been filed with the following main reliefs:

"i. issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 28.11.2025 passed by the opposite party No.3 to the extent of proposed deduction of amount of Rs. 3,56,786/- towards 'incentive deduction' out of the total arrears of salary of the petitioner being amount of Rs.8,11,922/-, as contained in Annexure No.1 to the writ petition.

ii. issue a writ, order or direction in the nature of mandamus commanding the opposite parties especially opposite party No.3 and 4 to release the entire admitted amount of provident fund and arrears of salary i.e. Rs. 13,90,557/- + 4,55,136/(Total= 18,45,693/-) including proposed deduction amount of Rs. 3,56,786/- in favour of the petitioner, forthwith as mentioned in the order dated 28.11.2025 (Annexure No.1 to the writ petition) alongwith interest @ 9.5% on delayed payment."

The submission of learned counsel for the petitioner is that so far as the

grant of incentives is concerned, that is disputed between the parties, as the respondents has rejected the claim of the petitioner while considering the representation on the said issue. He further submits that so far as the other dues to the tune of 18 lakh and odd is concerned, that is payable to the petitioner and the interest of justice would be served if this court is pleased to direct the respondents to make payment of the same during the pendency of the writ petition.

Learned counsel for the respondent nos. 2 to 5 submits that he may be granted some time to seek instructions as to whether these are his dues or not and if the same are pending, then within what period of time, payment of the same would be made.
