This application has been filed seeking mandamus to direct the respondents to release and pay the arrears of salary along with all admissible allowances to the petitioner for the period of 21.08.2018 to 08.08.2021 with the further direction to grant all consequential service benefits to the petitioner.

Learned counsel for the petitioner submits that in pursuance of the Government Order dated 03.08.2018 and consequential order dated 18.08.2018 passed by Joint Director, Education Board, the petitioner was adjusted from Acharya Dwivedi Inter College, Raebareli to R.M.P. Inter College, Sitapur. Feeling aggrieved, the petitioner preferred petitions bearing Writ Petition (S/S) No. 3765 of 2019 and 15135 of 2019. Thereafter, Special Appeal No. 193 of 2021 was also filed. It is further submitted that as the petitioner was directed to resume the duties, he joined at the transferred place on 09.08.2021.

Submission of the learned counsel for the petitioner is that there was a dispute regarding the salary of the petitioner for the period of 21.08.2018 to 08.08.2021, which came before the Joint Director of Education 6th Mandal, Lucknow and it was decided vide order

dated 31.03.2023 with the observation that the petitioner had no fault, therefore, he is entitled for the salary for the aforesaid period, which shall be paid to him in accordance with law by the competent authority. The copy of the aforesaid order was communicated to Director, Secondary Education, Additional Director, Secondary Education, District Inspector of Schools, Sitapur as well as Raebareli and Finance and Accounts Officer, Sitapur and Raebareli. However, despite the aforesaid order, when the salary for the aforesaid period was not paid to the petitioner, he again moved a representation to the District Inspector of Schools, Sitapur as well as Raebareli, but no attention was paid on the same, due to which, the present petition has been filed.

Drawing the attention of the Court towards the letter dated 13.03.2026 issued by District Inspector of Schools, Raebareli addressed to District Inspector of Schools, Sitapur, which was placed before this Court and is on record, learned counsel for the petitioner submits that the copy of the same was also communicated to the petitioner and in the said letter, it is mentioned that salary of the petitioner for the aforesaid period shall be paid by the District Inspector of Schools, Sitapur and a request was made for taking necessary action in pursuance of the directions issued by Joint Director, 6th Mandal, Lucknow vide order dated 31.03.2023.

It is submitted that in pursuance of the instructions sought vide order dated 17.03.2026, a letter dated 20.03.2026 written by District Inspector of Schools, Sitapur to District Inspector of Schools, Raebareli is placed before this Court, in which, it is mentioned that in the LPC of the petitioner, which was sent by District Inspector of Schools, Raebareli, the details for the said period is not mentioned and also asked for corrected LPC.

The aforesaid letter dated 20.03.2026 is taken on record.

31.03.2023 had already decided the controversy, the copy which was also communicated to District Inspector of Schools, Sitapur and, therefore, it is obligatory upon him to make payment to the petitioner of the due salary for the period of 21.08.2018 to 08.08.2021, but the same is not being done. It is, thus, submitted that appropriate order may be passed in the matter.

Learned Additional Chief Standing Counsel opposes the prayer of the petitioner and submits that since the corrected LPC of the petitioner is required, the salary for the aforesaid period cannot be paid to him.

Considering the arguments advanced by the learned counsel for the petitioner, learned Additional Chief Standing Counsel and going through the contents of the petition as well as other relevant documents, including the letters mentioned above, it is evident that the controversy related to the due salary of the petitioner for the period of 21.08.2018 to 08.08.2021 has already been decided by Joint Director of Education 6th Mandal, Lucknow vide order dated 31.03.2023, in which, a direction was issued to make payment of salary in accordance with law. The copy of the said order was communicated to the District Inspector of Schools, Sitapur, where the petitioner was working at the point of time.

उपयुर्क्त िवषयक अपने कायार्लय के पत्रांक माध्यिमक/8444-45/2025-26 िदनांक 28 फरवरी 2026 का सन्दभर् ग्रहण करने का कष्ट करें, िजसके द्वारा मा० उच्च न्यायालय, इलाहाबाद, खण्डपीठ लखनऊ में योिजत िरट यािचका संख्या 1677 (िरट-ए) / 2026 राम अकबाल बहादुर िसह बनाम उ०प्र० राज्य व अन्य में पािरत आदेश िदनांक 16.02.2026 के क्रम में श्री राम अकबाल बहादुर िसह से०िन० सहायक अध्यापक (सम्बद्ध प्राईमरी अनुभाग), आर०एम०पी० इण्टर कालेज, सीतापुर सम्प्रित आचायर् िद् व ेदी इण्टर कालेज रायबरेली द्वारा यािचका के माध्यम से वांिछत ितिथ िदनांक 21.08.2018 से 08.08.2021 तक के अवशेष के भुगतान के सम्बन्ध में अपने स्तर से यथाशीघ्र आवश्यक अिग्रम कायर्वाही करने का कष्ट करें।

उक्त के सम्बन्ध में अवगत कराना है िक संयुक्त िशक्षा िनदेशक, षृष्ठ मण्डल, लखनऊ के कायार्लय आदेश संख्या मा0/6040-48/2018-19 िदनांक 18 अगस्त 2018 द्वारा श्री राम अकबाल बहादुर िसह को जनपद रायबरेली के अशासकीय सहायता प्राप्त माध्यिमक िवद्यालयो के सम्बद्ध प्राइमरी अनुभाग में पद िरिक्त न होने के कारण आर०एम०पी० इण्टर कालेज सीतापुर के सम्बद्ध प्राइमरी अनुभाग में समायोिजत िकया गया है। उक्त के अनुपालन में प्रािधकृत िनयंत्रक, आचायर् िद् व ेदी इण्टर कालेज रायबरेली ने अपने आदेश संख्या प्रा०िन० /71/2 सम्प्रित 018-19 िदनांक 20.8.2018 द्वारा श्री राम अकबाल बहादुर िसह को आर०एम०पी० इण्टर कालेज सीतापुर के िलए कायर्मुक्त कर िदया गया है एवं अधोहस्ताक्षरी के कायार्लय पत्रांक मा०/6125-30/2021-22 िदनांक 09.12.2021 द्वारा श्री राम अकबाल बहादुर िसह का एल०पी०सी० संलग्न कर आपको आवश्यक कायर्वाही हेतु प्रेिषत िकया गया है।

संयुक्त िशक्षा िनदेशक, षष्ठ मण्डल, लखनऊ के कायार्लय पत्रांक मा0-1/15641-45/202324 िदनांक 31.03.2023 द्वारा श्री राम अकबाल बहादुर िसह, स०अ०, आर०एम०पी० इण्टर कालेज, सीतापुर के प्राथर्ना पत्र िदनांक 19.01.2023 के िनस्तारण िनणर्य में उल्लेख िकया गया है िक श्री राम अकबाल बहादुर िसह, स०अ०, आर०एम०पी० इण्टर कालेज, सीतापुर िनवासी-378, मॉ अम्बे िनवास, प्रकाश नगर, रायबरेली के प्राथर्ना पत्र िदनांक 19.01.2023 तथा तत्क्रम में िजला िवद्यालय िनरीक्षक, रायबरेली द्वारा उपलब्ध करायी गयी आख्या के पिरशीलोपरान्त उपयुर्क्त की गयी िववेचना / विणत िस्थितयों में श्री राम अकबाल बहादुर िसह स०अ०, आर०एम०पी० इण्टर कालेज, सीतापुर की कोई त्रुिट पिरलिक्षत न होने के कारण मा० उच्च न्यायालय, खण्डपीठ लखनऊ में योिजत िवशेष अपील संख्या-193/2021 में मा० उच्च न्यायालय, खण्डपीठ लखनऊ द्वारा िदनांक 23.07.2021 को पािरत प्रभावी अंश के अनुपालन में श्री राम अकबाल बहादुर िसह के िदनांक 21.08.2018 से िदनांक 08.08.2021 तक के वेतन का भुगतान व सम्बिन्धत अन्य लाभों के भुगतान के सम्बन्ध में िनयमानुसार कायर्वाही िकये जाने हेतु सवर्सम्बिन्धत को िनदेर्िशत िकया जाता है।"

प्राथर्ना पत्र िदनांक 19.04.2025 में मा० उच्च न्यायालय, खण्डपीठ लखनऊ में योिजत िवशेष अपील संख्या-193/2021 में पािरत आदेश िदनांक 23.07.2021 के क्रम में िदनांक 21.08.2018 से िदनांक 08.08.2021 तक के वेतन का भुगतान हेतु आपको िवभागीय िनयमों / िविनयमों के आलोंक में आवश्यक कायर्वाही करने का कष्ट करें, उक्त के क्रम में आपके कायार्लय के पत्रांक अवशेष/1386-89/2025-26 िदनांक 29 मई 2025 द्वारा प्रबन्धक / प्रधानाचायर्, आर०एम०पी० इण्टर कालेज सीतापुर को िनदेर्िशत िकया गया है िक उक्त प्रकरण में िवभागीय िनयमों / िविनयमों के आलोक में आवश्यक कायर्वाही करने का कष्ट करें। पुनः आपके कायार्लय के पत्रांक अवशेष/3212-15/2025-26 िदनांक 19 अगस्त 2025 द्वारा श्री राम अकबाल बहादुर िसह, स०अ०, के प्राथर्ना पत्र िदनांक 14.08.2025 के क्रम में प्रबन्धक / प्रधानाचायर्, आर०एम०पी० इण्टर कालेज सीतापुर को िनदेर्िशत िकया गया है िक उक्त प्रकरण के सम्बन्ध में िनयमानुसार कायर्वाही करने का कष्ट करें।

पुनः संयुक्त िशक्षा िनदेशक, षृष्ठ मण्डल, लखनऊ के कायार्लय पत्रांक मा0-1/734142/2025-26 िदनांक 25.10.2025 द्वारा श्री राम अकबाल बहादुर िसह, से०िन० स०अ०, आर०एम०पी० इण्टर कालेज, सीतापुर के प्राथर्ना पत्र िदनांक 09.09.2025 के क्रम में िदनांक 21.08.2018 से िदनांक 08.08.2021 तक के वेतन का भुगतान हेतु आपको िवभागीय िनयमों / िविनयमों के आलोक में आवश्यक कायर्वाही करने का कष्ट करें।

जैसा िक आप अवगत है िक िशक्षा िनदेशक (मा०), उ०प्र०, िशक्षा सामान्य (1) तृतीय अनुभाग , प्रयागराज के कायार्लय पत्रांक सामान्य (1) तृतीय / 15834-909/2024-25 िदनांक 16.08.2024 द्वारा िनदेर्िशत िकया है िक अशासकीय सहायता प्राप्त माध्यिमक िवद्यालयों के प्रधान/प्रवक्ता / सहायक अध्यापकों के स्थानान्तरण के फलस्वरूप उनके वेतन भुगतान कायर्भार ग्रहण करने वाले िवद्यालय को एल०पी०सी० को संज्ञान में लेते हुए सम्पूणर् वेतन भुगतान कायर्भार ग्रहण करने वाले िवद्यालय से/जनपद से कराया जाना सुिनिश्चत िकया जायें।

It has been submitted by learned counsel for the petitioner that the respondent has not released arrears of salary along with the admissible allowances to the petitioner for the period 21.8.2018 to 8.8.2021, though the matter has been finalized after order dated 31.3.2023 passed by the Joint Director of Education, 6th Mandal, Lucknow and the petitioner is running from pillar to post. On the other hand, learned counsel for the respondent-Department prays for and is granted ten days time to seek instructions in the matter.

Mr. Ran Vijay Singh, learned counsel appearing for the State, submits that letter was sent to the District Inspector of Schools, Sitapur, and the District Inspector of Schools, Raebareli was impleaded subsequently with the permission of the Court, therefore, the communication could not be sent to him earlier.

He prays for and is granted one week's time to obtain instructions from District Inspector of Schools, Raebareli.

Mr. Ravi Singh, learned counsel for the petitioner, submits that the District Inspector of Schools, Raebareli has sent å letter dated 13.03.2026 to the petitioner on the WhatsApp. A copy of the same is placed before this Court, which is taken on record.

Referring the said letter dated 13.03.2026, he submits that it has been mentioned therein that the payment shall be made by the District Inspector of Schools, Sitapur.

मा० उच्च न्यायालय के आदेश िदनांक 17.03.2026 द्वारा याची के िदनांक 21.08.2018 से 08.08.2021 तक के अवशेष प्रकरण संयुक्त िशक्षा िनदेशक, षृष्ठ मण्डल लखनऊ ने अपने पत्रांक-मा०-1/15641-45/2023-24 िदनांक 31.03.2023 द्वारा िनस्तािरत िकया गया है िजसमें आपका ध्यान आकृष्ट करते हुए संज्ञान में लाना है िक िनस्तारण आदेश के िववेचना प्रस्तर-05 में स्पष्ट िकया गया है िक- "5-मा० उच्च न्यायालय खण्ड पीठ लखनऊ में योिजत िवशेष अपील संख्या-193/2021 में मा० उच्च न्यायालय खण्डपीठ लखनऊ द्वारा िदनांक 23.07.2021 को पािरत प्रभावी अंश के अनुपालन में श्री राम अकबाल बहादुर िसह के िदनांक 21.08.2021 से िदनांक 08.08.2021 तक के वेतन का भुगतान से सम्बिन्धत अन्य लाभों के भुगतान के संबंध में उिचत रूप से िवचार िकये जाने पर यह िवचारणीय तथ्य पाया गया िक कायार्लय संयुक्ते िशक्षा िनदेशक, षृष्ठ मण्डल लखनऊ के आदेश िदनांक 18 अगस्त, 2018 के अनुपालन में तत्कालीन प्रािधकृत िनयन्त्रक, आचायर् िद् व ेदी इण्टर कालेज, रायबरेली के कायर्मुक्त आदेश िदनांक 20.08.2018 में कायर्मुक्त िकये जाने की ितिथ, पूवार्न्ह / अपरान्ह का उल्लेख न होने और सम्बिन्धत समायोिजत/कायर्मुक्त िशक्षकों को कायर्मुक्त आदेश का अनुपालन िकये जाने हेतु कोई प्रितिलिप न िकये जाने से तत्कालीन प्रािधकृत िनयत्रंक, आचायर् िद् व ेदी इण्टर कालेज, रायबरेली द्वारा वास्तिवक रूप से श्री राम अकबाल बहादुर िसह को िवद्यालय से कायर्मुक्त िकया जाना िसद्ध/पुिष्टत नहीं है। अतएव ऐसी िस्थित में तत्कालीन प्रािधकृत िनयन्त्रक, आचायर् िद् व ेदी इण्टर कालेज, रायबरेली द्वज्ञरा की गयी गम्भीर तकनीकी त्रुिट/चूक के िलए श्री राम अकबाल बहादुर िसह को उत्तरदायी मानते हुए उनके िदनांक 21.08.2018 से िदनांक 08.08.2021 तक के वेतन का भुगतान व सम्बिन्धत अन्य लाभों का भुगतान अवरूद्ध रखा जाना औिचत्यपूणर् नहीं है"।

उपरोक्त विणत पिरिस्थितयों में प्रकरण में प्रािधकृत िनयंत्रक आचायर् िद् व ेदी इण्टर कालेज, रायबरेली द्वारा श्री राम अकबाल बहादुर िसह को िनयमानुसार / िविधवत कायर्मुक्त न िकये जाने के कारण उक्त प्रकरण में याची श्री राम अकबाल बहादुर िसह की कोई त्रुिट पिरलिक्षत नहीं होती है। ऐसी िस्थित में श्री राम अकबाल बहादुर िसह को उक्त अविध का वेतन भुगतान िकया जाना िवचारणीय है, िजसकी प्रितिलिप आपको को भी की गयी है िजससे स्पष्ट हो रहा है िक श्री राम अकबाल बहादुर िसह की देयता आपके जनपद के स्तर पर प्रदिशत हो रही है।

उक्त के अितिरक्त आपके कायार्लय पत्रांक- लेखा/10430-37/2025-26 िदनांक 13.03.2026 द्वारा इस कायार्लय के पत्रांक-मा० /8444-45/2025-2026 िदनांक 28.02.2026 िजसमें याची श्री राम अकबाल बहादुर िसह द्वारा िदनांक 21.08.2018 से 08.08.2021 तक के अवशेष के भुगतान की प्राथर्ना के सम्बन्ध में अपने जनपद रायबेरली के स्तर पर िनयमानुसार कायर्वाही हेतु िकये गये पत्राचार के सम्बन्ध में िनम्नवत् तथ्य प्रस्तुत करते हुए जनपद सीतापुर से याची के भुगतान के सम्बन्ध में कायर्वाही िकये जाने हेतु पत्र प्रेिषत िकया गया है, िजसमें उिल्लिखत िकया गया है िशक्षा िनदेशक (मा०) उ०प्र० िशक्षा सामान्य (1) तृतीय अनुभाग, प्रयागराज के कायार्लय पत्रांक-सामान्य (1) तृतीय /15834909/2024-25 िदनांक 16.08.2024 के िनदेर्श िक अशासकीय सहायता प्राप्त माध्यिमक िवद्यालयों के प्रधान/प्रवक्ता/सहायक अध्यापकों के स्थानान्तरण के फलस्वरूप उनके वेतन भुगतान कायर्भार ग्रहण करने वाले िवद्यालय को एल०पी०सी० का संज्ञान लेते हुए सम्पूणर् वेतन भुगतान कायर्भार ग्रहण करने वाले िवद्यालय से/जनपद कराया जाना सुिनिश्चत िकया जायेगा, िजसके अनुक्रम में िनयमानुसार अिग्रम कायर्वाही िकये जाने के सम्बन्ध में पत्राचार िकया गया है।

उक्त के अितिरक्त आप द्वारा अपने पत्र िदनांक 13.03.2026 में िशक्षा िनदेशक महोदय के िनदेर्शानुसार अशासकीय सहायता प्राप्त माध्यिमक िवद्यालयों के प्रधान/प्रवक्ता / सहायक

अध्यापकों के स्थानान्तरण के फलस्वरूप उनके वेतन भुगतान कायर्भार ग्रहण करने वाले िवद्यालय को एल०पी०सी० का संज्ञान लेते हुए सम्पूणर् वेतन भुगतान कायर्भार ग्रहण करने वाले िवद्यालय से/जनपद कराये जाने का तथ्य प्रस्तुत िकया गया है, के संदभर् में अवगत कराना है िक याची के िजस जनपद की देयता शून्य है तथा आप द्वारा उपलब्ध करायी गयी एल०पी०सी० में याची श्री राम अकबाल बहादुर िसह के िदनांक 21.08.2018 से 08.08.2021 तक के अवशेष का कोई उल्लेख नहीं है।

अतः श्री राम अकबाल बहादुर िसह के िदनांक 21.08.2018 से 08.08.2021 तक के अवशेष के सम्बन्ध में यिद जनपद सीतापुर से ही भुगतान कराया जाना है तो उपरोक्त भुगतान की देयता िनधार्िरत करते हुए संशोिधत एल०पी०सी० उपलब्ध कराने का कष्ट करें तािक याची के उक्त भुगतान में आवश्यक कायर्वाही की जा सकें।

Taking into consideration the aforesaid order as well as letters of the authorities concerned, it is evident that in the order dated 31.03.2023 passed by Joint Director of Education 6th Mandal, Lucknow, while deciding the controversy, a firm opinion was taken that payment of salary for the aforesaid period be paid to the petitioner and all the concerned authorities including the District Inspector of Schools, Sitapur were directed to ensure the compliance, but the same has not been complied.

List this case on 31.03.2026 within top 10 cases.

In case, the salary for the period in question has not been paid to the petitioner in the meantime, Joint Director of Education 6th Mandal, Lucknow as well as District Inspector of Schools, Sitapur shall appear before this Court on the next date.
