Heard Sri Anand Dubey, learned counsel for the petitioners, Sri S.B. Pandey, learned Deputy Solicitor General of India assisted by Sri Varun Pandey, learned counsel for the opposite parties no. 1 & 2, Sri Anagh Mishra, learned counsel for the opposite parties no. 3 to 5 and perused the record.

Under challenge in this writ petition, are the advertisements dated 1107-2025 and 11-11-2025 regarding recruitment on two posts of Assistant Administrative Officer in AIIMS, Raebareli.

It is submitted by the learned counsel for the petitioners that the petitioners are working as Junior Administrative Officer in AIIMS, Raebareli and they are entitled for promotion on the post of Assistant Administrative Officer. He submits that it is in very much illusion and confusion that whether the AIIMS, Raebareli is adopting the Recruitment Rules of Non Faculty Posts for New AIIMS, 2015 or the

directions of the CIB dated 10-12-2018. He submitted that two stands are being taken by the respondent-authorities in the matter of recruitment and promotions on the post concerned. Therefore, submission is that the advertisements dated 11-07-2025 and 11-112025, being against the Rules, may be quashed.

On the other hand, learned Senior Counsel appearing for the opposite parties no. 1 & 2 on the basis of instructions submits that AIIMS, Raebareli is following the Recruitment Rules of Non Faculty Posts for New AIIMS, 2015 and the advertisements have also been published in consonance thereof. He further submitted that there are four posts of Assistant Administrative Officers and out of four posts, two posts will fall under the promotional quota as per the Rules, 2015 and those two posts are already filled up. He also submitted that the recruitment for two posts of Assistant Administrative Officer has been published through advertisement and there is no ambiguity or erroneousness at all as those are not against any provision of the Recruitment Rules of Non Faculty Posts for New AIIMS, 2015.

In Rejoinder, Sri Anand Dubey, learned counsel for the petitioners submits that he has filed another writ petition, wherein another stand has been taken by the respondent-authorities with that petitioner, as they are following the norms/guidelines/instructions of the CIB dated 10-12-2018 for recruitment.

As prayed, let this matter be posted on 16-01-2026, as fresh.
