The Court took on record the instruction dated 16.3.2026 sent by the Tehsildar, Tehsil Attara, filed in compliance of its earlier order. Learned Standing Counsel for the State respondents (Satyendra Bhusan Dubey) submitted, on the basis of the instruction, that the petitioner himself encroached upon Gaon Sabha plot No. 427, that the public interest litigation at the petitioner's instance is therefore not maintainable and should be dismissed with cost, and that a proceeding under Section 67 of the U.P. Mr. Satyendra Bhusan Dubey, learned Standing Counsel for the State respondents on the basis of the instruction submitted that petitioner himself encroached the Gaon Sabha plot No. 427, as such, the instant public interest litigation at the instance of petitioner cannot be entertained rather the same should be dismissed with cost. He further submitted that proceeding under Section 67 of U.P. Revenue Code, 2006 has already been registered in respect to the area of the plot which are in illegal possession of the person concerned.
