Heard Sri Adarsh Singh, the learned counsel for the petitioner, Sri Anil Kumar Kushwaha, the learned Standing Counsel appearing on behalf of the State and perused the records.

The learned counsel for the petitioner has filed an application for amendment to correct the description of the opposite party no.1 so as to make it State of U.P. through Principal Secretary, Department Revenue instead of State of U.P. through Principal Secretary, Department of Home. The application is taken on record.

The application is formal in nature and it is allowed. The learned counsel for the petitioner shall make necessary corrections in the petition forthwith.

By means of the instant petition filed in public interest the petitioner has sought a direction for removal of encroachments made on land bearing Gata Nos.222 measuring 05240 hectare, 226 measuring 0.0860 hectare, 50 measuring 0.0380 hectare and 323 measuring 0.610 hectare, which are recorded as shamshan/marghat situated in Village Chak Karimabad, Gaon Sabha Mittai, Pargana Deva, Tehsil Nawabganj, District Barabanki.

On the basis of written instructions provided by the Sub Divisional Magistrate, Nawabganj, District Barabanki the learned

Standing Counsel has stated that there were some temporary encroachments on the land in question which have been removed and the grievance of the petitioner stands redressed. The copy of written instructions are taken on record.

Accordingly, the petition is disposed off in terms of the statement made in the written instructions.

The learned counsel for the petitioner has submitted that the petitioner's name is Vijay Kumar, whereas the computer system of this court is showing his name as Vinay Kumar.

The Registry is directed to get the name of petitioner corrected from Vinay Kumar to Vijay Kumar in the records/computer system of this court.
