Smt. Neetu Singh v. Kamlesh Kumar
Case brief
What is this about?
Section 24 CPC transfer application dismissed; transfer of matrimonial/divorce case under Section 13 Hindu Marriage Act; Family Court No. 2 Sitapur to Lucknow; convenience of parties versus best interest of litigation; balance of convenience not sufficient ground; transfer casts doubt on judge's competence; evidence-stage proceedings nearing conclusion; Government teacher applicant; counter affidavit; order sheet 12.01.2026; cross-examination O.P.W.-1; Nagendra Sharma (2025) SCC OnLine All 8489; Abdul Nazar Madani (2000) 6 SCC 204; no order as to costs; Syed Qamar Hasan Rizvi, J.; Allahabad High Court Lucknow Bench; TACL No. 2 of 2026.
What did the court decide?
No universal or hard-and-fast rules can be prescribed for deciding a transfer petition; it must always be decided on the facts of each case. Transfer of a case from one court to another is a serious matter because it indirectly casts doubt on the competence of the judge from whom the matter is transferred, and should not be done without proper and sufficient cause; the power under section 24 of the Code of Civil Procedure 1908 may not be interfered with in a casual manner unless a strong case for transfer is made out establishing that continuation of the case in a particular court would lead to injustice or the suit was filed there for the purpose of working injustice.
