Rakhi Shukla vs Rajesh Kumar

The present application under Section 24 of C.P.C. has been preferred by the applicant for transfer of Original Suit No. 657 of 2025 (Rajesh Kumar Versus Rakhi), under Section 13 of Hindu Marriage Act, from the Court of Principal Judge, Family Court, Unnao to a Court of equivalent jurisdiction at District Raebareli. "

In compliance of order of this Court dated 18.02.2026, applicant Rakhi Shukla is present in person before this Court.

On 18.02.2026 this Court passed the following orders:-

"1. Shri Dharmendra Trivedi, learned counsel for applicant is present.

This Court vide order dated 02.02.2026 issued notice to opposite party through Chief Judicial Magistrate, Unnao with the direction that the applicant and opposite party shall appear in person before this Court on 18.02.2026. Further, the Senior Registrar of this Court was directed to ensure the communication of this order to the Chief Judicial Magistrate, Unnao, for its compliance.

submitted by Joint Registrar (e-court) shows that the notice to opposite party Mr. Rajesh Kumar through learned Chief Judicial Magistrate, Unnao was deemed served through his mother. As per report received from the office of the learned Chief Judicial Magistrate, Unnao recipient not met at the address indicated, rather his mother met who refused to receive the notice and informed that opposite party Mr. Rajesh Kumar lives in Ludhiana, Punjab. Further, the opposite party Mr. Rajesh Kumar was informed through his mobile number to remain present before the Hon'ble Court on the date fixed. As such, service of notice upon the opposite party is deemed sufficient.

In compliance of order of this Court dated 02.02.2026 the applicant Rakhi Shukla is present but despite the communication of order dated 02.02.2026, opposite party is not present.

However, in the interest of justice, put up this case on 10.03.2026 as fresh.

The Superintendent of Police, Unnao is directed to ensure presence of opposite party, namely, Mr. Rajesh Kumar before this Court on the next date fixed.

The Senior Registrar of this Court is directed to send a copy of this order to the Superintendent of Police, Unnao for necessary compliance."

Perusal of office report dated 20.02.2026 shows that the copy of the transfer application as well as the order was sent to the Superintendent of Police, Unnao through e-mail for service of the same on the opposite party.

From perusal of the aforesaid report, it is evident that the notice has been served upon the opposite party.

Today when the case has been taken up, none is present on behalf of the opposite party.

¶45

In view of the above, let counter affidavit be filed by the opposite party within four weeks.

Rejoinder affidavit, if any, may be filed within two weeks thereafter.

¶47

List immediately after expiry of the aforesaid period.

¶48

Till the next date of listing, proceedings of the Original Suit No. 657 of 2025 (Rajesh Kumar Versus Rakhi), under Section 13 of Hindu Marriage Act pending before the the Court of Principal Judge, Family Court, Unnao, shall remain stayed.
