Heard learned counsel for the applicant, learned A.G.A. for the State and learned counsel appearing for the complainant.

The present bail application has been filed on behalf of the applicant seeking anticipatory bail in F.I.R. No. 37 of 2026, under Sections 115(2), 351(3), 105 BNS and Section 3(2)(v) SC/ST Act, Police Station Haliyapur, District Sultanpur.

Learned counsel for the applicant submits that the applicant has falsely been implicated in the present case. It is further submitted that as per prosecution case, the incident was taken place on 05.04.2026. It is also alleged therein that after the incident, the injured was immediately taken to the hospital. Learned counsel for the applicant vehemently submits that there is no evidence that the injured person was brought to the hospital after the alleged incident. It is also submitted that in pursuance of the earlier order dated 21.05.2026, medico legal report is placed before this Court by learned A.G.A., which reveals that the injured was brought to the hospital on 07.04.2026. It is vehemently submitted that there is no explanation of two days, i.e., from 05.04.2026 to 07.04.2026. Learned counsel for the applicant, while assuring that the applicant will cooperate in the investigation, submits that the applicant does not have any criminal antecedent and the police is

trying to arrest in the present case, though no custodial interrogation is necessary. In such circumstances, applicant is entitled for protection of this Court under the provisions of anticipatory bail.

Learned A.G.A. as well as learned counsel for the complainant vehemently oppose the prayer of the applicant, but are not in a position to explain the status of injured for the aforesaid two days, i.e., from 05.04.2026 to 07.04.2026.

I have considered the argument of the learned counsel for the applicant, learned A.G.A., learned counsel for the complainant and gone through the contents of the F.I.R., bail application and other relevant records.

Keeping in view the reasons, as stated above, a case for interim bail to the applicant is made out. Thus, having regard to all the facts and circumstances of the case, the present anticipatory bail application stands finally disposed of with the direction that till the submission of the police report, if any, under Section 173(2) Cr.P.C. before the competent court, in the event of arrest of the applicant- Daya Ram @ Daya Ram Maurya, involved in aforesaid F.I.R., he shall be released on anticipatory bail on his furnishing personal bond of Rs.50,000/- with two sureties each in the like amount to the satisfaction of the Station House Officer of the police station concerned with the following conditions:-

(i) The applicant shall make himself available for interrogation or for discovery of any fact by a police officer/investigating officer as and when required and will cooperate in the investigation.

(ii) The applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer;

(iii) The applicant shall not leave the country without the previous permission of the Court.

(iv) The applicant shall deposit his passport with the trial court and if he has not been issued any passport, an affidavit in this regard shall be filed by him before the trial court.

Any violation of above conditions will be treated misuse of bail and court below will be at liberty to pass appropriate order in the matter.
