Jyoti Balmiki vs State of U.P.

The present application has been moved seeking anticipatory bail in Case Crime no. 147 of 2013 under Sections 409, 419, 420, 467, 468, 471, 120-B IPC, Police Station Kotwali Nagar, District Barabanki with the prayer that in the event of arrest, the applicant may be released on bail.

It is contended by learned counsel for the applicant that co-accused Neelam and Smt. Meena have already been enlarged on anticipatory bail by Co-ordinate Bench of this Court vide separate orders dated 28.11.2025 passed in Crl. Misc. Anticipatory Bail Application Nos.7589 of 2025 and 7567 of 2025 respectively. It is further submitted that FIR has been lodged in the year 2013 and the investigation is still going on. It is further submitted that as per allegations in the FIR, some of the amount of National Fund Pension Scheme is said to have been fraudulently withdrawn by the applicant and other co-accused persons and during investigation, it has surfaced that pension amounting to Rs.20,000/- has been credited to the bank account of the applicant in 13 installments. It was also submitted that applicant undertakes to cooperate during trial and she would appear as and when required by the investigating agency or Court. It has been stated that in case the applicant is granted anticipatory bail, she shall not misuse the liberty of bail and will co-operate with the investigation and would obey all conditions of bail.

On the other hand, learned A.G.A. has opposed the prayer for grant of anticipatory bail.

I have considered the rival submissions made by learned counsel for the parties.

bail by Co-ordinate Bench of this Court. FIR has been lodged in the year 2013 and the investigation is still going on. Applicant is not named in the FIR as per which, some amount of National Fund Pension Scheme is said to have been fraudulently withdrawn by some of the co-accused persons and during investigation, it has surfaced that pension amounting to Rs.20,000/- has been credited to the bank account of the applicant in 13 installments.

Considering the facts and circumstances of the case and without expressing any opinion on the merits of the case, let the applicant Jyoti Balmiki in the event of her arrest, be released on interim anticipatory bail on her furnishing a personal bond of Rs. 50,000/- with two sureties each in the like amount to the satisfaction of the Court concerned till 30.3.2026 with the following conditions :-

(i) The applicant shall not tamper with evidence and that she would appear before the trial Court on the date fixed unless exempted by the Court concerned;

(ii) The applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her/them from disclosing such facts to the Court or to any police officer;

(iii) The applicant would co-operate during trial and would not misuse the liberty of bail.

(iv) The applicant shall not leave India without prior permission of the Court concerned.

In default of any of the conditions, the prosecution shall be at liberty to file appropriate application for cancellation of anticipatory bail granted to the applicant.

Put up this case as fresh on 30.3.2026.

In the meantime, learned AGA is directed to obtain updated instructions in the matter by the next date fixed.
