The present bail application has been filed seeking anticipatory bail in Case Crime/FIR No. 146/2025, under Sections 191(2), 191(3), 115(2), 110, 352, 351(2) BNS, Police Station Umri Begumganj, District Gonda.

Heard learned counsel for the applicants and learned A.G.A. for the State.

It is alleged in the prosecution case that on 08.07.2025 at about 7:00 p.m., on account of a long-standing land dispute between the parties, the named accused persons confronted Anil Singh, Manisha Singh and Shivani, who are members of the same family. During the course of the altercation, the accused persons allegedly used filthy and obscene language, making abusive references to the complainant’s mother and sister. It is further alleged that they physically assaulted the victims with a sharp-edged weapon as well as with lathis, and also inflicted blows by fists and slaps. As a result of the said assault, Manisha Singh allegedly sustained injuries and became unconscious, collapsing at the spot. It is also alleged that the accused persons extended threats to the life and property of the victims.

Learned counsel for the applicants submits that applicant no. 1 is a 69-yearold person; applicant no. 2 is his daughter; and applicant no. 3 is his wife. It is contended that all three applicants have been falsely implicated due to the pre-existing land dispute and family enmity. It is further submitted that during the course of investigation, the applicants have fully cooperated with

the Investigating Officer and that the charge sheet has already been filed; thus, their custodial interrogation is no longer required.

Learned counsel further submits that, as per the medical evidence on record, only Manisha Singh sustained a fracture in the occipital bone, whereas the remaining injuries attributed to the other injured persons are simple in nature. It is also argued that the offences alleged are punishable with imprisonment up to a maximum of seven years. The applicants have cooperated throughout the investigation and undertake to continue cooperating during the course of trial proceedings.

Upon due consideration of the submissions advanced, particularly the fact that applicant no. 1 is a senior citizen aged about 69 years; applicant nos. 2 and 3 are women; the offences alleged are punishable with imprisonment up to seven years; the charge sheet has already been submitted; and the allegations in the prosecution case are general and omnibus in nature against four accused persons; and further taking into account the law laid down by the Hon’ble Supreme Court in Sushila Aggarwal and others versus State (NCT of Delhi) and another, (2020) 5 SCC 1, and without expressing any opinion on the merits of the case, I am of the view that, as an interim measure, it would be appropriate to grant interim protection to the applicants.

Till the next date of listing, it is provided that in the event of arrest, the applicants, namely, Talukdar Singh, Vibha @ Pallavi Singh and Subhadra Singh , shall be released on interim anticipatory bail on furnishing personal bonds and two sureties each in the like amount to the satisfaction of the court concerned, subject to the following conditions:-

(1) The applicants shall cooperate in the trial and shall not influence the witnesses.
