The present anticipatory bail application has been filed by the applicant in relation to FIR/Case Crime No.289 of 2024 under Sections 323, 376, 506 I.P.C., Police Station - Kotwali Murtiha, District - Bahraich.

For the purposes of entertaining the present application and protecting the interest of the applicant, this Court considered the facts as indicated including that:-

(i). The applicant is innocent and he has falsely been implicated in the present case. It is also that the applicant is not named in the F.I.R.

¶13

(ii). According to the F.I.R, the informant/opposite party no. 2, Kiran Verma, had made some investment in the company of co-accused Ram Naresh Verma namely, LUCC The Loni Urban Multi State Credit And Thift Co-operative Society under allurement of lucrative returns.

(iii). On 23.12.2021, the informant decided to invest and thereafter provided a sum of Rs. 1,25,000/-, to the co-accused- Ram Naresh Verma, and thereafter, he provided a bond of Rs. 1,00,000/- to the informant.

(iv). Subsequently, on 13.11.2024, when the informant reached the house of the co-accused Ram Naresh Verma and demanded refund of the entire invested amount, then the informant was scolded and threatened to life by Aman and Gulshan, sons of the co-accused, whose names also finds place in the F.I.R.

This Court also considered that the interest of the co-accused persons namely, Maya Singh Rajpoot and Uttam Kumar Singh Rajpoort @ Uttam Singh Rajput, have already been protected by this Court vide order(s) dated 03.06.2025 passed in CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS Nos. - 588 of 2025 and 593 of 2025, respectively and these order(s) have been made absolute by this Court on 19.12.2025.

5 This Court also considered that specific allegation has not been levelled against the present applicant in the F.I.R.

In continuation to above, it is also considered that the case in which the applicant has been implicated i.e. Case Crime Nos. 295 of 2024, 292 of 2024, 293 of 2024 and 294 of 2024, all under Sections 316(5), 318(4), 338, 336(3), 340(2), 111(2)(ii), 61(2) B.N.S and 3/21 of The Banning of Unregulated Deposit Scheme Act, 2019, P.S Badosari, District Barabanki, has already been released on bail.

Learned counsel for the applicant undertakes that the applicant shall cooperate in the trial.

Learned A.G.A. opposed the prayer made by applicant's counsel.

Taking note of the aforesaid, this Court finds that the interest of the applicant is liable to be protected.

Accordingly, as an interim measure, it is provided that in the event of arrest, the accused-applicant -Arati be released forthwith in the aforesaid case crime on anticipatory bail on his furnishing a personal bond of Rs.25,000/- and two sureties in the like amount to the satisfaction of Station House Officer of the Police Station/Court concerned, with the following conditions:-

(i) That the accused-applicant shall make himself available for interrogation by police authorities as and when required and will cooperate with the investigation;

¶28

(ii) That the accused-applicant shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer; and

¶29

(iii) That the accused-applicant shall not leave India without the previous permission of the Court.
