The present anticipatory bail application has been filed by the applicant in relation to Case Crime No. 300 of 2025, under Sections- 80(2), 85 B.N.S. and Section- 3/4 D.P. Act, Police Station- Pisawan, District- Sitapur.

While pressing the instant application, the learned counsel for the applicant stated that the marriage of the son of applicant namely Amit Kumar was solemnized with Neetu, who committed suicide on 12.07.2025, as would appear from the post-mortem report on record, as per which the cause of death is asphyxia due to ante-mortem hanging.

It is further stated that thereafter the FIR was lodged by the father of the deceased making vague and bald allegations against all the family members namely Amit Kumar (husband of deceased), Lalta Prasad (father-in-law of deceased), Smt. Lalli/applicant (mother-in-law of deceased), Anil (brotherin-law of deceased) and Buta (Jethani/sister-in-law of deceased).

It is further stated that the interest of the applicant was protected by the Division Bench of this Court vide order dated 11.08.2025 passed in Criminal Misc. Writ Petition No. 7109 of 2025 (Lalli vs. State of U.P. and others) and therefore she was not apprehended.

It is further stated that other co-accused persons namely Amit Kumar (husband of deceased), Anil (brother-in-law of deceased) and Lalta Prasad (father-in-law of deceased) have also been enlarged on regular bail by this Court vide orders dated 18.12.2025, 09.12.2025 and 10.12.2025 passed in Criminal Bail Application Nos. 12821 of 2025, 12077 of 2025, 12381 of 2025.

It is also stated that all the evidence has been collected by the prosecution

as charge sheet has already been filed and therefore custodial interrogation of the applicant is not required.

Considering the aforesaid facts of the case and also the case of prosecution against the applicant indicated in the FIR, this Court finds that the applicant is entitled to interim protection.

Accordingly, as an interim measure it is provided that in the event of arrest, the accused-applicant- Smt. Lalli be released forthwith in the aforesaid case crime (supra) on anticipatory bail on furnishing a personal of Rs. 25,000/- and two sureties (one of family member/close relative) each in the like amount to the satisfaction of Station House Officer of the Police Station concerned/Court concerned with the following conditions:-

(i) That the accused-applicant shall make herself available for interrogation by police authorities as and when required and will cooperate with the investigation;

(ii) That the accused-applicant shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the court or to any police officer; and

¶23

(iii) That the accused-applicant shall not leave India without the previous permission of the Court.

Let the informant be informed by the SHO concerned regarding pendency of the instant case.

Learned AGA is directed to communicate this order to the SHO concerned forthwith and place the proof regarding the information given by the S.H.O. concerned to the complainant/victim by way of an affidavit when the case is listed next.
