Jagveer vs State of U.P. and Another

The present application has been moved seeking anticipatory bail in Case Crime no. 294 of 2025 under Sections 137(2), 87 of B.N.S., Police Station Harduaganj, District Aligarh with the prayer that in the event of arrest, the applicant may be released on bail.

It is contended by learned counsel for the applicant that applicant is not named in the FIR and his name has surfaced during investigation and co-accused Rahul whose name also surfaced during investigation has already been granted regular bail by the learned Sessions Court. It is further submitted that the victim has not stated anything against the applicant and she has stated in her statement recorded under section 183 BNSS that she left her home on her own free will and that she got married with coaccused Rahul as she was in love with him.

On the other hand, learned A.G.A. submits that applicant has been assigned the role of extending help to the victim and co-accused Rahul in getting their marriage solemnized with each other. He further submits that as per the marksheet of class VII, date of birth of the victim is 29.8.2005 whereas in the marriage certificate issued by Arya Samaj, her date of birth has been mentioned as 01.1.2007. Learned AGA also submits that applicant has criminal history of one case which has not been explained by him.

In reply, learned counsel for the applicant submits that there is no radio-logical report, high school or school leaving certificate of the victim available on record in order to ascertain her age.

by the learned Sessions Court. Victim has not stated anything against the applicant and she has stated in her statement recorded under section 183 BNSS that she left her home on her own free will and that she got married with co-accused Rahul as she was in love with him. She has also stated in her statement that applicant extended help in getting the marriage of the victim solemnized with co-accused Rahul.

Considering the facts and circumstances of the case and without expressing any opinion on the merits of the case, let the applicant Jagveer in the event of his arrest, be released on interim anticipatory bail on his furnishing a personal bond of Rs. 50,000/- with two sureties each in the like amount to the satisfaction of the Court concerned till 23.3.2026 with the following conditions :-

(i) The applicant shall not tamper with evidence and that he would appear before the trial Court on the date fixed unless exempted by the Court concerned;

(ii) The applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her/them from disclosing such facts to the Court or to any police officer;

(iii) The applicant would co-operate during trial and would not misuse the liberty of bail.

(iv) The applicant shall not leave India without prior permission of the Court concerned.

In default of any of the conditions, the prosecution shall be at liberty to file appropriate application for cancellation of the interim anticipatory bail granted to the applicant.

Put up this case as fresh on 23.3.2026.

In the meantime, applicant is directed to file supplementary affidavit bringing on record his entire criminal history.
