Heard Shri Sanjeev Kumar Shukla, learned counsel for the applicant as well as the learned A.G.A. for the State and perused the record.

The applicant has filed this application under Section 483 Cr.P.C. with the following main prayer:

".. Issue an order or direction directed the Additional Chief Judicial Magistrate Room No- 21 Sultanpur Criminal Case No- 1661 of 2025 Under Section- 138 N.I Act P.S Kotwali Nagar, District Sultanpur (Alankar Tandon vs. Devendra Singh) expeditiously as early as possible within stipulated time."

Learned counsel for the applicant submits that the aforesaid case is pending since 2025 without substantial progress, hence, a positive direction be given to the trial court to decide the aforesaid case within a stipulated period.

Learned A.G.A. has no objection on the prayer made by the learned counsel for the applicant and submits that merely keeping pending the same by the trial court does not suffice any purpose of the litigation.

In view of the aforesaid facts, the court concerned is directed to adhere to the provisions of Section 143(3) of the N.I. Act and shall act

accordingly and decide the aforesaid case expeditiously in accordance with law within a period of six months from the date a certified copy of this order is placed before the court concerned, if there is no legal impediment.
