Heard Shri Ashok Shukla, learned counsel for the applicant as well as the learned A.G.A. for the State and perused the record.

The applicants have filed this application under Section 483 Cr.P.C. with the following main prayer:

".. to issue a direction to the Court of Additional Court No. 4, Lucknow to decide Complaint Case No. 88623 of 2021 (M/S Gauri Apartments Resident Welfare Association vs. Sanjay Capoor) under Section 138 of the Negotiable Instruments Act expeditiously within such time as stipulated by this Hon'ble Court."

Learned counsel for the applicant submits that the aforesaid case is pending since 2021 without substantial progress, hence, a positive direction be given to the trial court to decide the aforesaid case within a stipulated period.

Learned A.G.A. has no objection on the prayer made by the learned counsel for the applicant and submits that merely keeping pending the same by the trial court does not suffice any purpose of the litigation.

In view of the aforesaid facts, the court concerned is directed to adhere to the provisions of Section 143(3) of the N.I. Act and shall act accordingly and decide the aforesaid case expeditiously in accordance with law within a period of six months from the date a certified copy of
