Supplementary affidavit has been filed annexing with the copy of the Cheque which was dishonored, is taken on record.

The matter relates to money dispute.

During argument, learned counsel for the appellant states that the cheque in question has been dishonored regarding which applicant has filed a suit before the court below which is still pending adjudication. He further states that if the opposite party no.2 returns the aforesaid amount to the applicant as mentioned in the cheque in question then he will withdraw his case.
