Heard Sri Vivek Kumar Tiwari, learned counsel for the applicants, Sri Yasharth Ojha, learned counsel for the opposite party no.2 and Sri Ram Prakash Shukla, learned counsel for the State and perused the record.

The present application under Section 528 BNSS has been filed by the applicants Aalok Singh @ Vivek Kumar Singh, Shani Singh @ Vishal Singh, Happy Singh @ Navneet Singh and Mannu Singh @ Nitin Singh, with the following prayers:

“It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to allow this application and quash the chargesheet no. 91 of 2023 dated 29.04.2023, as well as the entire criminal proceedings of S.S.T. No. 10 of 2024, arising out of Case Crime No. 64 of 2023, under Sections 323, 504, 506 and 427 I.P.C. and Section 3(2)(Va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Police Station Kerakat, District Jaunpur, pending before the learned Special Judge, SC/ST Act, Jaunpur, in the interest of justice.

It is further prayed that this Hon'ble Court may graciously be pleased to direct a fair and proper further investigation by a competent and independent investigating officer, after considering the CCTV footage, electronic evidence and other material available on record,

It is further prayed that this Hon'ble Court may graciously be pleased to stay the further proceedings of the aforesaid criminal case during the pendency of the present application, otherwise the applicants shall suffer irreparable loss and injury.

Learned counsel for the applicants submits that previously the applicants had filed appeal being Criminal Appeal No. 1875 of 2024 (Alok Singh and 3 others Vs. State of U.P. and another) which stood dismissed vide order dated 18.08.2025, copy of the order has been placed before the Court which is annexure 11 to the affidavit. The same reads as under:

"1- अपीलाथर् की ओर से उनके िव्षान अिधव्वा तथा िवप्षी संख्या 2 की ओर से उनके िव्षान अिधव्वा एवं राज्य की ओर से िव्षान अपर शासकीय अिधव्वा को सुना एवं प्ऴावली का सम्यक पिरशीलन िकया।

2-यह दािण्डक अपील, अपीलाथर् की ओर से अन्तगर्त धारा 14-ए (1) एस० सी०/एस० टी० एक्ट, 1989 इस आशय से योिजत की गयी है िक मुकदमा अपराध संख्या 64 वषर् 2023, (राज्य ्ऺित अलोक एवं अन्य), अन्तगर्त धारा 323, 504, 506, 427 भा० दं० सं० एवं धारा 3 (2) (व) एस० सी०/एस०टी० एक्ट, थाना केराकत, िजला जौनपुर में िव्षान िवशेष न्यायाधीश, (एस.सी./एस. टी. एक्ट) जौनपुर ्षारा पािरत ्ऺसं्ञान आदेश िदनांक 16-1-2024 तथा ्ऺेिषत आरोप प्ऴ संख्या 91 वषर् 2023 िदनांिकत 29-42023 को िनरस्त िकया जाए।

3-अपीलाथर्गण के िव्षान अिधव्वा ्षारा कथन िकया गया िक अपीलाथर्गण िनददरॏष है। उन्हें ्ऺश्नगत मामले में गलत ा़ंग से झूठा फसाया गया है। अपीलाथर्गण ्षारा ऐसा कोई अपराध कािरत नहीं िकया गया है जैसा िक ्ऺश्नगत ्ऺाथिमकी में विणत िकया गया है। अपीलाथर्गण का ्ऺश्नगत मामले से कोई वास्ता व सरोकार नहीं है। सम्बिन्धत िववेचक ्षारा सही ा़ंग से ्ऺश्नगत मामले की जांच नहीं की गयी और गलत ा़ंग से आरोप प्ऴ अपीलाथर्गण के िवरु्ध न्यायालय में ्ऺेिषत िकया गया है। िव्षान िवचारण न्यायालय ्षारा गलत ा़ंग से ्ऺसं्ञान आदेश पािरत िकया गया है जो िविध संगत नहीं एवं िनरस्त होने योग्य है।

4-इसके िवपरीत िवप्षी संख्या 2 के िव्षान अिधव्वा तथा िव्षान अपर शासकीय अिधव्वा ्षारा अपीलाथर्गण के िव्षान अिधव्वा के तकरॏ का िवरोध िकया गया एवं कथन िकया गया िक सम्बिन्धत िववेचक ने समुिचत साष्य संकिलत कर अपीलाथर्गण के िवरू्ध आरोप प्ऴ न्यायालय में ्ऺेिषत िकया है। िव्षान िवचारण न्यायालय ्षारा पािरत ्ऺसं्ञान आदेश में कोई िविधक ्ऴुिट एवं अिनयिमतता नहीं है। ऐसी दशा में अपीलाथर्गण की यह अपील िनरस्त होने योग्य है।

5-्ऺकरण के समस्त तथ्य एवं पिरिस्थितयों को दृि्िगत रखते हुए अपीलाथर्गण के िवरू्ध पािरत ्ऺश्नगत तलबी आदेश में हस्त्षेप का कोई आधार नहीं पाया जाता है। तदनुसार यह अपील बलहीन है एवं िनरस्त होने योग्य है।

6- तदनुसार अपीलाथीगण की यह अपील िनरस्त की जाती है।

7-हालांिक यह आदेिशत िकया जाता है िक यिद अपीलाथर्गण िव्षान अवर न्यायालय के सम्ष उपिस्थत होकर उपरो्व विणत ्ऺकरण में जमानत हेतु ्ऺाथर्ना प्ऴ ्ऺस्तुत करते है तो उनके जमानत ्ऺाथर्ना प्ऴ का िनस्तारण िनयमानुसार शी्स से शी्स िकया जाए।"
