State of U.P. and Another (order dated March 10, 2026): Applicants sought quashing of the charge sheet dated 16.01.2025 (Charge Sheet No. 16/2025), the cognizance/summoning order dated 02.05.2025 passed by the Chief Judicial Magistrate, Mathura, and the entire proceedings of Criminal Case No. 35875 of 2025 under Sections 115(2), 352, 351(2)(3), 324(4)(5) B.N.S., 2023, arising out of Case Crime No. 611 of 2024, P.S. Vrindaban, District-Mathura, on the basis of a compromise entered into between the parties on 03.01.2026, it being stated that the dispute was settled out of court and O.P. no.2 did not wish to proceed. Heard Sri Ashwani Kumar, learned counsel for the applicants, Sri Pankaj Kumar, learned A.G.A. for the State.

Learned counsel for the applicants submits that he has filed the instant application under Section 528 BNSS on the strength of compromise with the relief which has been mentioned in the prayer clause of the application. The relief which has been mentioned in the application is delineated below:-

"It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to quash the charge sheet dated 16.01.2025 (Charge Sheet No. 16/2025), Cognizance/Summoning order dated 02.05.2025 passed by Chief Judicial Magistrate, Mathura as well as the entire proceedings of Criminal Case No. 35875 of 2025 (State versus Anuj and others) under Sections 115(2), 352, 351(2)(3), 324(4)(5) B.N.S., 2023 arising out of Case Crime No. 611 of 2024 P.S. Vrindaban, District-Mathura, pending in the court of Chief Judicial Magistrate, Mathura the case on the basis of compromise entered in between the parties on 03.01.2026 with a further prayer to stay the entire aforenoted proceedings."

Learned counsel for the applicants submits that both the parties have resolved the dispute between them out of the Court and they are residing peacefully in the society and both have no grievances with each other. He further submits that the O.P. no.2 does not want to proceed with the criminal case against the applicants and in this regard he has filed an application mentioning that both the parties have settled their dispute out of court.

In view of aforesaid submissions, both the parties are directed to appear before the concerned trial court on 20.03.2026 for verification of the compromise application. Further, the trial court is directed to verify the compromise application on appearance of the parties before it and after verification of the compromise application, verification report/order shall be sent to this Court by the concerned trial court on or before 02.04.2026.

Learned counsel for the applicants may also file the verification report/order along with an affidavit.

Put up this case on 02.04.2026 as fresh.
