The present application under Section 528 BNSS has been filed for quashing non-bailable warrant order dated 03.11.2022 passed by learned Chief Judicial Magistrate, Varanasi in Case No.8800 of 2008 (State vs. Ghanshyam Singh and Others) arising out of Case Crime No.683 of 2007, under sections 143, 504, 506 IPC, P.S. Cantt., District- Varanasi.

On perusal of entire record appended along with instant application, this Court does not find it to be a case where interference of this Court is required. No such ground appears to be available in the present application, on the basis of which, impugned order, can be set aside.

Accordingly, the prayer sought through the instant application, is refused.

Lastly, learned counsel for applicants submitted that liberty may be granted to applicants to surrender before the court concerned in pursuance to impugned non-bailable warrant order dated 03.11.2022 issued against them to which learned AGA has no objection.

In view of the aforesaid, the instant application is finally disposed of with a direction to the applicants to appear before learned court concerned in pursuance to impugned non-bailable warrant order dated 03.11.2022 within 15 days from today. Till 15 days from today, no coercive action shall be initiated against the applicants. After the expiry of aforesaid period of 15 days, learned concerned court is directed to proceed as per law.
