Heard Sri Ashfaq Ahmed Ansari, learned counsel for the applicant and Sri Amit Dubey, learned AGA for the State.

Perusal of the complaint and the impugned order indicates that the complainant was medically examined.

Learned AGA has pointed out that there is no assertion in the affidavit accompanying the application under Section 528 B.N.S.S. that there was no medical examination of the injured or that there was any medical report on the record.

In view of objection raised, learned counsel for the applicant is directed to file a supplementary affidavit bringing relevant medical reports on record, if any.

¶14

Learned AGA shall also seek instructions with respect to medical examination of the injured in the case.

Put up as fresh on 10.02.2026.
