Vs. Naman) under sections 333, 115(2), 352, 351(2), 351(3) B.N.S., Police Station Jagdishpura, District Agra, pending before the Juvenile Justice Board, Agra, on the basis of a compromise dated 29.09.2025. Both sides reported an out-of-court settlement and O.P. no.2 did not wish to proceed. Heard Sri Ajay Kumar Pandey, learned counsel for the applicant and Sri Alok Singh, learned counsel for O.P. no.2.

Learned counsel for the applicants submits that he has filed the instant application under Section 528 BNSS with the relief which has been mentioned in the prayer clause of the application.

The relief which has been mentioned in the application is delineated below:-

"It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to quash the Charge sheet dated 11.06.2025, cognizance order dated 22.08.2025 as well as the entire proceeding of Case Crime No. 348 of 2025 (State of U.P. Vs. Naman:) under section 333, 115(2), 352, 351(2), 351(3) of the B.N.S. Police Station Jagdishpura,, District Agra, pending before Juvenile Justice Board, Agra, in the light of compromise dated 29.09.2025, otherwise the applicant shall suffer irreparable loss and injury.

It is further prayed that this Hon'ble Court may also be pleased to stay the further proceedings of Case Crime no. 348 of 2025 (State of U.P. Vs. Narman) under section 333, 115(2), 352, 351(2), 351(3) of the B.N.S. Police Station Jagdishpura,, District Agra, pending before Juvenile Justice Board, Agra, in the light of compromise dated 29.09.2025, during the pendency of the present application under Section 528 of B.N.S.S. before this Hon'ble Court, otherwise the applicant shall suffer irreparable

loss and injury."

Counsel for both the parties submit that the parties have settled their dispute out of the Court and they are residing peacefully in the society and both have no grievances with each other. The O.P. no.2 does not want to proceed with the criminal case against the applicants. Learned counsel for the applicant submits that he has filed compromise application along with supplementary affidavit which is available on record.

Learned counsel for the applicant submits that though the compromise application has been written in hostile manner, but actually the incident has occurred and learned counsel undertakes that the applicant will not commit such incident in future. Learned counsel for O.P. no.2 submits that though such incident has been occurred with O.P. no.2, but the applicant-accused will not harm O.P. no.2 (victim) in future.

On the assurance given by learned counsel for the parties as well as on the assurance of natural guardian of the applicant, this Court invoking inherent jurisdiction under Section 528 BNSS, directs the concerned trial court/Juvenile Justice Board, Agra to take further undertaking as the applicant shall not commit such offence in future and verify the compromise application on appearance of both the parties before it. Both the parties are directed to appear before the concerned trial court on 20.01.2026 for verification of the compromise application.

After verification of the compromise application, verification report/order shall be sent to this Court by the concerned trial court through the Registrar (Compliance) of this Court. Learned counsel for the applicant may also file the verification report along with an affidavit.
