Heard Sri Akhilesh Kumar Dwivedi, learned counsel holding brief of Sri Raghvendra Tripathi, learned counsel for the applicants and Sri Pankaj Kumar, learned State Law Officer for the State.

Learned counsel for the applicants submits that he has filed the instant application under Section 528 BNSS on the strength of compromise with the relief which has been mentioned in the prayer clause of the application. The relief which has been mentioned in the application is delineated below:-

"It is therefore, most respectfully prayed that this Hon"ble Court may graciously be pleased to allow this application and may quash the entire proceeding of Criminal Case of No. 360 of 2012 (State Vs. Ram Raj), including cognizance and summoning order dated 18.11.2012 passed by learned Judicial Magistrate, Bansi, Siddharth Nagar against the present Applicants including charge sheet bearing Charge sheet No.A 306 of 2011 dated 26.01.2013 under section- 419, 420, 467, 468, 471 and 120 I.P.C.. Police Station- Kotwali, Bansi, District Siddharth Nagar arising out of first information report dated 15.02.2011 registered as case Crime No. 45 of 2011, under section 419, 420, 467, 468, 471 I.P.C., Police Station-Kotwali, Bansi, District Siddharth Nagar pending in the Court of learned Judicial Magistrate, Bansi, Siddharth Nagar in respect to the Applicants only.

It is further prayed that this Hon'ble Court may kindly be pleased to Stay

the entire proceeding of Criminal Case of No. 860 of 2012 (State Vs. Ram Raj), including cognizance and summoning order dated 18.11.2012 passed by learned Judicial Magistrate, Bansi, Siddharth against Nagar the present Applicants including charge sheet bearing Charge sheet No. A 306 of 2011 dated 26.01.2013 under section-419, 420, 467, 468, 471 and 120 I.P.C., Police Station- Kotwali, Bansi, District Siddharth Nagar arising out of first information report dated 15.02.2011 registered as case Crime No. 45 of 2011, under section 419, 420, 467, 468, 471 IPC, Police Station-Kotwali, Bansi, District Siddharth Nagar pending in the Court of learned Judicial Magistrate, Bansi, Siddharth Nagar in respect to the Applicants only, during the pendency of the present criminal misc. application, otherwise the Applicants shall suffer irreparable loss and injury. And/or pass such other and further order which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."

Learned counsel for the applicants submits that the applicants and O.P. No.2 are family members and they have resolved their dispute out of the Court and the O.P. no.2 does not want to proceed with the criminal case against the applicants. He further submits that some date may be fixed for appearance of both the sides before the trial court for verification of the compromise application.

In view of aforesaid submissions, both the parties are directed to file the compromise application before the concerned trial court on 16.02.026 and thereafter, both the parties shall appear before the trial court on 18.03.2026 for verification of the compromise application. Further, the trial court is directed to verify the compromise application on appearance of the parties before it and after verification of the compromise application, verification report/order shall be sent to this Court by the concerned trial court. Learned counsel for the applicants may also file the verification report along with an affidavit.

List this case on 31.03.2026 as fresh.

In case any warrant (bailable or non-bailable) or any other process under Cr.P.C. has been issued against the applicants in Criminal Case No.860 of 2012 (State vs. Ram Raj) arising out of Case Crime No.45 of
