आवेदक धीरज श्रीवास्तव की ओर से धारा 528 भारतीय सुरक्षा संिहता के अंतगर्त यह आवेदन पत्र, वाद सं० 288/2020, अंतगर्त धारा 125(3) सी.आर.पी.सी, में िवद्वान अपर प्रधान न्यायाधीश, पिरवार न्यायालय संख्या-01, कानपुर नगर द्वारा पािरत प्रश्नगत आदेश िद० 25.06.2025 को अपास्त िकये जाने हेतु एवं वाद संख्या-1888 वषर् 2023 (Neela Vs. Dhiraj), अंतगर्त धारा 13B िहदू िववाह अिधिनयम के अंितम रूप से िनस्तािरत होने तक आवेदक के िवरुद्ध आदेश िदनांिकत 25.06.2025 के अनुपालन में कोई प्रपीड़क कायर्वाही न िकये जाने हेतु योिजत की गयी है।

आवेदक के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधकता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदक के िवद्वान अिधवक्ता का कथन है िक िवद्वान अपर प्रधान न्यायाधीश, पिरवार न्यायालय संख्या-01, कानपुर नगर द्वारा िदनांक 12.04.2016 को िवपक्षी सं० 02 का भरण-पोषण प्राथर्ना पत्र स्वीकार करते हुए आवेदक द्वारा िवपक्षी सं० 02 को प्राथर्ना पत्र प्रस्तुत करने की ितिथ से वाद के िनस्तारण होने तक, बतौर अंतिरम भरण-पोषण धनरािश कुल अंकन 5,000/- प्रितमाह की दर से भुगतान करने का आदेश पािरत िकया गया है, जो न्यायोिचत नहीं है, उक्त आदेश पािरत करते समय आवेदक की आय व आय के श्रोत पर ध्यान नहीं िदया गया एवं आवेदक की आय इतनी नहीं है िक वह भरण-पोषण की उक्त धनरािश िवपक्षी सं० 02 को अदा कर सके।

िवद्वान अपर शासकीय अिधवक्ता द्वारा कथन िकया गया िक प्रश्नगत आदेश िदनांक 12.04.2016 के द्वारा आवेदक को आदेिशत िकया गया िक वह िवपक्षी सं० 2/उसकी पत्नी

को धारा 125 दं०प्र०सं०, प्राथर्नापत्र प्रस्तुत करने की ितिथ से धनरािश अंकन रु० 5,000/भरण-पोषण धनरािश प्रत्येक माह अदा करने का आदेश पािरत िकया गया, िकन्तु आवेदक द्वारा दुराशय के तहत अभी तक उक्त धनरािश का भुगतान िवपक्षी संख्या-2 को नहीं िकया गया है, िजसके कारण आवेदक के िवरुद्ध िगरफ्तारी एवं वसूली अिधपत्र िनगर्त हो चुका है, िकन्तु आवेदक द्वारा प्रश्नगत आदेश का अनुपालन नहीं िकया जा रहा है।

प्रश्नगत मामले के तथ्यों एवं पिरिस्थितयों के दृिष्टगत यह आदेिशत िकया जाता है िक यिद आवेदक अब तक के संपूणर् बकाया धनरािश रु० 5,60,000/- (पाँच लाख साठ हजार रुपए) में से रु० 50,000/- (पचास हजार रुपए) िदनांक 08.05.2026 तक िवपक्षी सं० 02 को प्रदान करता है तो अिग्रम िनयत ितिथ (िदनांक 09.07.2026) तक आवेदक के िवरुद्ध आदेश िदनांिकत 25.06.2025 के अनुपालन में कोई प्रपीड़क कायर्वाही नहीं की जाएगी।

यहाँ पर यह स्पष्ट िकया जाता है िक इस न्यायालय के अन्तिरम आदेश के अनुपालन में िनगरानीकतार् द्वारा जो भी धनरािश िवपक्षी संख्या-2 को अदा की जाती है, वह धनरािश संबंिधत िवचारण न्यायालय द्वारा पािरत अंितम आदेश के अनुसार िनयत की गयी भरण-पोषण भत्ते की धनरािश में समायोिजत की जाएगी।

मामला िवचारणीय है।

िवपक्षी संख्या-2 को शीघ्र ितिथ के िलए नोिटस जारी िकया जाए। एक सप्ताह के भीतर आवश्यक कदम उठाए जाएं।

10 तत्पश्चात, इस वाद को िदनांक 09.07.2026 को सूचीबद्ध िकया जाय।

आवेदक के िवद्वान अिधवक्ता अिग्रम िनयत ितिथ पर रु० पचास हजार िवपक्षी संख्या-2 के पक्ष में प्रदान िकये जाने एवं धारा 13B िहदू िववाह अिधिनयम के अंतगर्त संबंिधत न्यायालय में िनयिमत रूप से उपिस्थत होने के संबंध में अनुपालन आख्या प्रस्तुत करेंगे।
