आवेदकगण की ओर से धारा 528 भारतीय नागिरक सुर्षा संिहता के अन्तगर्त यह आवेदन प्ऴ , पिरवाद सं० 157 सन 2022 (ओम ्ऺकाश बनान कािलका व अन्य) अन्तगर्त धारा 323, 380, 504 भा०दं०िव०, थाना कोतवाली मिड़याहूं, िजला जौनपुर में अपर मुख्य न्याियक मिजस ् ेट, कोटर् नं० 01, कोटर् नं० 12, जौनपुर ्षारा पािरत ्ऺ सं्ञान/तलबी आदेश िद० 10.11.2025 एवं आदेश िदनांक 25.02.2026 के ्षारा िनगर्त एन.बी.डब्ल्यू. को अपास्त करने हेतु योिजत िकया गया है।

िवप्षी सं० 2 की ओर से िव्षान अिधव्वा ्शी पी.के. िव्षकमार् ्षारा वकालतनामा दािखल िकया गया, इसे प्ऴावली पर रखा जाय।

आवेदकगण के िव्षान अिधव्वा, िवप्षी सं० 2 के िव्षान अिधव्वा एवं िव्षान अपर शासकीय अिधव्वा ्शी चन्दन िसह को सुना तथा प्ऴावली का पिरशीलन िकया।

आवेदकगण के िव्षान अिधव्वा के तकॏल को ्श वणोपरान्त, प्ऴावली के पिरशीलन से न्यायालय ने पाया िक पिरवाद में लगाए गए आरोप एक सं्ञेय अपराध के कमीशन का खुलासा करते हैं एवं वह आरोप, िकए गए िववेचना/ अवलोकन के उपरान्त लगाए गए हैं। उन आरोपों को इस न्यायालय ्षारा धारा 528 बी.एन.एस.एस. के तहत अपनी शि्व का ्ऺयोग करते हुए, जॉच के दौरान एक्ऴ की गयी साम्षी के आरोपों की शु्धता और िव्षसनीयता का आकलन करने की आवश्यकता नहीं है। इस स्तर पर आवेदकगण/ अिभयु्वगण के िववािदत बचाव पर िवचार नहीं िकया जा सकता है। तद्नुसार, ्ऺसं्ञान या उपरो्व वाद की कायर्वाही को र्द करने की ्ऺाथर्ना और पिरणामी कायर्वाही अस्वीकृत की जाती है।

िव्षान अपर शासकीय अिधव्वा ्षारा कथन िकया गया िक संबंिधत िवचारण न्यायालय ्ष ारा अिभयु्व के िवरू्ध बी.डब्ल्यू./एन.बी.डब्ल्यू. िनगर्त िकया जा चुका है। इससे पिरलि्षत है

िक अिभयु्व ्षारा िवचारण में सहयोग ्ऺदान नहीं िकया जा जा रहा है। इसिलए, इस आवेदन प्ऴ को िनरस्त कर िदया जाय।

इस स्तर पर, आवेदकगण के िव्षान अिधव्वा का अनुरोध है िक आवेदकगण को अभी तक उपरो्व मामलें में िगरफ्तार नहीं िकया गया है और पुिलस आवेदकगण को िगरफ्तार करने के ्ऺ यास में है और संबंिधत िवचारण न्यायालय ्षारा आवेदकगण के िखलाफ दण्डात्मक ्ऺि्वया जारी की जा सकती है। इसिलए, आवेदकगण के जमानत आवेदन प्ऴ पर िवचार करने के िलए संबंिधत िवचारण न्यायालय को िनदरॏश जारी कर िदया जाय।

उभय प्ष के िव्षान अिधव्वा के तकॏल के सुनने के उपरांत यहां ्ऺासंिगक है िक माननीय उच्चतम न्यायालय ्षारा Satendra Kumar Antil Vs. Central Bureau of Investigation and another (Special Leave to Appeal (Crl.) No. 5191 of 2021 के ्ऺकरण को आदेश िद० 07-10-2021 ्षारा पहले ही जमानत हेतु िदशा-िनदरॏश देते हुए िनस्तािरत िकया जा चुका है, इसके प्ाात् अब संबंिधत िवचारण न्यायालय को जमानत देने के िलए उनके िववेक और िवचार को िनयंि्ऴत करने वाले वैधािनक ्ऺािवधानों को ्ऺभािवत िकए िबना, इस न्यायालय ्षारा कोई िविश्ि िनदरॏश जारी करने की आवश्यकता नहीं है, क्योंिक यह अपे्षा की जाती है िक संबंिधत िवचारण न्यायालय आवेदकगण के जमानत ्ऺाथर्ना प्ऴ को िनस्तािरत करते समय माननीय उच्चतम न्यायालय ्षारा पहले से जारी आवश्यक िदशा-िनदरॏशों को ध्यान में रखेगा।

उपरो्व िटप्पिणयों के साथ , यह आवेदन प्ऴ अिन्तम रूप से िनस्तािरत िकया जाता है।
