आवेदक की ओर से धारा 528 भारतीय नागिरक सुरक्षा संिहता के अन्तगर्त यह आवेदन पत्र वाद सं० 1181/2019, अंतगर्त धारा 125 सी.आर.पी.सी. थाना नौबस्ता िजला कानपुर नगर में अपर प्रधान न्यायाधीश, पिरवार न्यायालय, कोटर् न. 01 कानपुर नगर के द्वारा पािरत प्रश्नगत आदेश िदनांक 06.12.2025 को अपास्त करने के िलए योिजत की गयी है।

आवेदक के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता श्री मनीष को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदक के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक उपर्युक्त मामलें में िवचारण न्यायालय द्वारा इस मामलें को पिरवाद के रूप में दजर् करते समय, तथ्यों का सम्यक पिरशीलन नहीं िकया गया तथा प्रश्नगत आदेश एक 'स्पीिकग' (सकारण) एवं तकर्संगत आदेश नहीं है तथा उक्त प्रश्नगत आदेश मात्र अनुमानों और कयासों के आधार पर पािरत िकया गया है। अतः उपरोक्त प्रश्नगत आदेश समुिचत िववेचना एवं तथ्यों पर आधािरत नहीं है। इसिलए, प्रश्नगत आदेश त्रुिटपूणर् है एवं अपास्त िकए जाने योग्य है।

िवद्वान अपर शासकीय अिधवक्ता ने कथन िकया िक आवेदक द्वारा अनुिचत रूप से िवलम्ब िकया जा रहा है। प्रश्नगत मामलें में समुिचत िववेचना के उपरांत िवचारण न्यायालय द्वारा पयार्प्त आधार पर प्रश्नगत आदेश पािरत िकया है, िजसमें कोई िविधक अथवा क्षेत्रािधकार संबंधी त्रुिट पिरलिक्षत नहीं हो रही है। उनका यह भी कथन है िक आवेदक के िवद्वान अिधवक्ता द्वारा प्रश्नगत आदेश को अपास्त करने हेतु जो तकर् प्रस्तुत िकए गए वे बलहीन है इसिलए, प्रश्नगत आदेश में हस्तक्षेप िकए जाने की कोई आवश्यकता प्रतीत नहीं हो रही है।
