आवेदकगण की ओर से धारा 528 बी.एऩ.एस.एस. के अन्तगर्त यह आवेदन पत्र, पिरवाद सं० 8677/2023, अन्तगर्त धारा 500/ 504/ 506 भा.दं.सं, थाना अकबरपुर, िजला कानपुर में चीफ जूडीिसयल मिजस्ट्रेट कानपुर देहात द्वारा पािरत प्रश्नगत आदेश िदनांक 07.08.2023 एवं अपरािधक पुनरीक्षण सं. 78/2025 आदेश िदनांक 05.02.2026 को रद्द करने के उद्देश्य से योिजत िकया गया है। 2. आवेदकगण के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदकगण के िवद्वान अिधवक्ता का तकर् है िक आक्षेिपत सम्मन आदेश के अवलोकन से प्रतीत होता है िक मिजस्ट्रेट ने आक्षेिपत आदेश में पिरवाद की िवषय-वस्तु और धारा 200 व 202 दंड प्रिक्रया संिहता के साक्ष्यों को तो दजर् िकया है, िकतु न तो साक्ष्यों की कोई िववेचना की गई और न ही इस पर िवचार िकया गया िक अिभयुक्त द्वारा किथत रूप से क्या कृत्य िकया गया था। आक्षेिपत आदेश में ऐसा कुछ भी नहीं है िजससे यह संकेत िमले िक मिजस्ट्रेट ने सम्मन आदेश पािरत करने से पूवर् मामले के तथ्यों पर िवचार भी िकया था। ऐसा कुछ भी मौजूद नहीं है िजससे यह दिशत हो िक मिजस्ट्रेट ने चुनौती िदए गए आदेश को पािरत करने से पूवर् मामले के तथ्यों, साक्ष्य या कानून पर िवचार िकया था। अतः ऐसा प्रतीत होता है िक वास्तव में. आक्षेिपत सम्मन आदेश पािरत करने से पूवर् न्याियक मिस्तष्क का प्रयोग नहीं िकया गया।

मामला िवचारणीय है।

िवपक्षी सं० 2 को नोिटस जारी हो। आवेदकगण की ओर से नोिटस भेजने के संबंध में आवश्यक पैरवी 1 सप्ताह के अन्दर की जाय।

िवपक्षी 4 सप्ताह में प्रितशपथपत्र दािखल करें। तत्पश्चात् आवेदकगण की ओर से 2 सप्ताह में प्रत्युत्तरशपथपत्र दािखल िकया जाय।

तत्पश्चात इस वाद को सूचीबद्ध िकया जाय।

प्रश्नगत मामले के समस्त तथ्यों एवं पिरिस्थितयों के दृिष्टगत उपरोक्त विणत वाद में आवेदकगण के िवरूद्ध अिग्रम आदेश तक कोई प्रपीड़क कायर्वाही नहीं की जाएगी।
