1.आवेदक जीतेन्द्र रावत की ओर से धारा 528 भारतीय सुरक्षा संिहता के अंतगर्त यह आवेदन पत्र, वाद सं० 109/2016, अंतगर्त धारा 125 सी.आर.पी.सी, थाना बल्देव, िजला मथुरा में अपर प्रधान न्यायाधीश (पिरवार न्यायालय)- मथुरा द्वारा पािरत तलबी आदेश िद० 15.04.2019 एवं आदेश िदनांक 13.02.2026 वाद सं. 1687/2019 के िवरुद्ध योिजत की गयी है।

आवेदक के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधकता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदक के िवद्वान अिधवक्ता का कथन है िक अितिरक्त प्रधान न्यायाधीश (पिरवार न्यायालय)- कोटर् न. 02, िफरोजाबाद िवपक्षी सं० 02 एवं 03 का भरण-पोषण प्राथर्ना पत्र स्वीकार करते हुए िवपक्षी सं० िवपक्षी सं० 02 एवं 03 को प्राथर्ना पत्र प्रस्तुत करने की ितिथ िदनांक 15.04.2019 से वाद के िनस्तारण होने तक, बतौर अंतिरम भरण-पोषण धनरािश अंकन 5,000/- प्रितमाह की दर से भुगतान करने का आदेश पािरत िकया गया है, जो न्यायोिचत नहीं है, क्योंिक उक्त आदेश पािरत करते समय आवेदक की आय व आय के श्रोत पर ध्यान नहीं िदया गया, िनगरानीकतार् की आय इतनी नहीं है िक वह भरण-पोषण की उक्त धनरािश िवपक्षी सं० 02 एवं 03 को अदा कर सके।

इस मामले के तथ्यों एवं पिरिस्थितयों के दृिष्टगत आवेदक को िनदेर्िशत िकया जाता है िक वह अब तक के संपूणर् बकाये धनरािश की िवपक्षी सं० 02 एवं 03 को अदा करें।

आवेदक द्वारा अब तक के संपूणर् बकाये धनरािश का भुगतान एक-एक महीने के अंतराल में 4 िकश्तो में अदा िकया जाएगा तथा प्रश्नगत आदेश में िनयत की गयी धनरािश अंकन 5000/- रूपये प्रितमाह आवेदक द्वारा िवपक्षी सं० 02 एवं 03 को भरण-पोषण भत्ते के रूप में दी जाने वाली धनरािश आगे प्रितमाह िनयिमत रूप से अदा की जाएगी।

यिद आवेदक द्वारा बकाये की उक्त धनरािश तथा िवपक्षी सं० 02 एवं 03 को रु० 5000/प्रितमाह की िनयिमत अदायगी की जाती है तो प्रश्नगत आदेश के अनुपालन में वसूली की

कायर्वाही स्थिगत रहेगी, िकन्तु यिद आवेदक द्वारा इस आदेश के अनुसार िनयत समयानुसार बकाया धनरािश की अदायगी नहीं की जाती है तथा प्रितमाह भरण-पोषण िदए जाने हेतु िनयत की गयी रु० 5000/- की धनरािश प्रितमाह अदा नहीं की जाती है, तो यह अंतिरम आदेश स्वतः िनष्प्रभावी समझा जाय।

संबंिधत िवचारण न्यायालय को िनदेर्िशत िकया जाता है िक उक्त वाद का अंितम रूप से िनस्तारण आज से 03 माह के अन्दर, उभय पक्ष को सुनवाई का समुिचत अवसर प्रदान करते हुए Crl. Appeal No. 730 of 2020, arising out of SLP (Crl.) No. 9503 of 2018 (Rajnesh vs. Neha & Anr.) में माननीय उच्चतम न्यायालय द्वारा प्रितपािदत िविध-व्यवस्था के प्रकाश में, इस न्यायालय के इस आदेश के िकसी भी िटप्पणी से प्रभािवत हुए िबना, गुण-दोष के आधार पर कर िदया जाय।

यहाँ पर यह स्पष्ट िकया जाता है िक इस न्यायालय के अन्तिरम आदेश के अनुपालन में िनगरानीकतार् द्वारा जो भी धनरािश 5000/- को अदा की जाती है, वह धनरािश संबंिधत िवचारण न्यायालय द्वारा पािरत अंितम आदेश के अनुसार िनयत की गयी भरण-पोषण भत्ते की धनरािश में समायोिजत की जाएगी।

तद्नुसार, यह आवेदन पत्र अिन्तम रूप से िनस्तािरत िकया जाता है।

कायार्लय को िनदेर्श िदया जाता है िक इस आदेश की एक प्रितिलिप संबंिधत न्यायालय को अिवलम्ब भेजना सुिनिश्चत िकया जाए।
