The instant appeal under Section 96 C.P.C. has been filed against the impugned judgment and decree dated 23.01.2026 passed by Civil Judge (Senior Division), Muzaffar Nagar in O.S. No.841 of 2024 (Vinay Goyal vs. Sandeep Paper Mills Pvt. Ltd. and others), whereby the defendants' application under Order 7 Rule 11 C.P.C. has been allowed and consequently, the plaint has been rejected on the ground that the dispute between the plaintiff and defendants fall within the category of commercial disputes, which is covered under the Commercial Courts Act, 2015.

Learned counsel for the plaintiff-appellant submits that the plaintiff supplied certain chemicals to the defendants and there was an understanding between the plaintiff and defendants that the defendants will make payment of the goods supplied to it within 30 days from their receipt but when the payment was not made for the goods supplied to the defendants then the plaintiff was constrained to file a suit for the recovery of unpaid consideration which does not fall within the category of commercial disputes as defined under Section 2 (1)(c) of the Commercial Courts Act, 2015, as such, the jurisdiction of the trial court was not barred but the trial court has held otherwise.
