Heard Sri Hari Shanker Tewari, Advocate, who appeared alongwith Sri Ajay Tiwari, the learned counsel for the revisionist, Sri Ajay Kumar Srivastava, the learned AGA for the State of U.P. and Sri Manoj Kumar Singh, the learned counsel for the opposite party No. 2 as well as perused the record.

The instant revision has been preferred seeking following main relief(s):-

"WHEREFORE, it is most respectfully prayed that this Hon'ble Court may be pleased to set-aside the judgment and order dated 12.12.2023 passed by the Additional Sessions Judge/Special Judge Pocso Act, Room No. 13, Sultanpur in Criminal Appeal No. 107 of 2023 "Dilshad Versus State of U.P." and order dated 11.7.2023 passed by the Principal Magistrate, Juvenile Justice Board, Sultanpur whereby the application dated 1.5.2023 for declaring the revisionist has been rejected, and instant criminal revision may be allowed."

Brief facts of the case are as under:-

(i) An FIR registered as Case Crime No. 0423 was lodged on 05.12.2017, under Section- 354(B) IPC and Section- 17/18 POCSO Act, 2012, Police Station- Lambhua, District- Sultanpur.

(ii) The name of the accused/revisionist finds place in the FIR.

¶16

(iii) As per the FIR, the accused/revisionist tried to outrage the modesty of the daughter, aged about 15 years, of the informant/opposite party No. 2.

(iv) After investigation, the charge sheet was filed under Section 354(B) IPC and Section(s) 17/18 POCSO Act, 2012.

¶18

(v) The accused/revisionist was apprehended and subsequently was released on bail and this fact is not in dispute.

(vi) During pendency of Special Trial No. 537/2018, under Section 354 (B) IPC and Section(s) 17/18 POCSO Act, 2012, Police StationLambhua, District- Sultanpur, the accused/revisionist preferred an application dated 28.02.2023 (Annexure No. 4 to the instant revision) before the Additional District Judge, POCSO Act, Court No. 12, DistrictSultanpur (in short "trial court") claiming juvenility.

(vii) The application dated 28.02.2023 was moved after recording the statement of accused/revisionist under Section 313 Cr.P.C. At this stage the accused/revisionist has indicated his age as 21 years.

(viii) The application dated 28.02.2023 was preferred on the basis of the copy of Pariwar Register, as per which the accused/revisionist was born on 08.09.2001.

(ix) The application dated 28.02.2023 was rejected by the trial court vide order dated 28.02.2023, which reads as under:-

प्राथीर् अिभयुक्त िदलशाद की ओर से प्राथर्नापत्र अन्तगर्त धारा 9 व 94 िकशोर न्याय अिध० 2015 प्रस्तुत कर कथन िकया गया है िक िकशोर न्याय अिधिनयम के अनुसार घटना में किथत िकशोर के शािमल होने पर िकसी भी न्यायालय में िकशोर द्वारा घटना के समय िकशोर होने का प्राथर्ना पत्र देने का प्रािवधान है। िकशोर न्याय अिधिनयम 2015 के धारा 94 में शैिक्षक प्रमाण पत्र के अभाव में न्याय पंचायत/ग्राम पंचायत का आयु सम्बन्धी प्रमाण पत्र सम्भाव्य आयु के िलये पयार्प्त साक्ष्य है। प्राथीर् को अपने आयु के सम्बन्ध में कोई शैिक्षक प्रमाण पत्र नहीं था, िकसी िवद्यालय का पढ़ा िलखा नहीं है। घरेलू िशक्षा से उदूर् िलखने पढ़ने की साधारण जानकारी है। िकशोर/ अिभयुक्त ने अपने बयान अं० धारा 313. जा० फौ० में अपनी आयु वतर्मान समय में 21 वषर् बताया था, जबिक घटना 4 वषर् पुरानी िदनांक 04.12.2017 की है। आधार काडर् के अनुसार प्राथीर् की जन्मितिथ 08.09.2001 है तथा पिरवार रिजस्टर के अनुसार भी ग्राम पंचायत व ग्राम सभा का नाम मझुई, परगना चांदा, तहसील लम्भुआ, िजला सुलतानपुर मकान सं०-104 स, िदलशाद सुत मोबीन की जन्मितिथ वषर् 2001 है। तदनुसार घटना के समय िकशोर होना प्रमािणत है। प्राथर्ना है िक प्राथीर् को आयु सम्बन्धी प्रमाण पत्र के अनुसार घटना के समय िकशोर यानी 18 वषर् से कम का मानते हुये सम्बिन्धत पत्रावली को सक्षम न्यायालय िकशोर न्याय बोडर् सुलतानपुर भेजने का कष्ट करें।

अभीयुक्त की ओर से पिरवार रिजस्टर व आधार काडर् की छायाप्रित दािखल की गयी है।

सुना एवं पत्रावली का अवलोकन िकया।

अिभयुक्त ने अपने धारा 313 द०प्र०सं० के बयान में बताया है िक वह पढ़ा िलखा है। अिभयुक्त ने अपनी आयु न्यायालय को अंदाज से 21-22 वषर् बतायी है। प्रस्तुत िकया गया पिरवार रिजस्टर धारा 94 िकशोर न्याय (बालकों की देखरेख) और संरक्षण अिधिनयम, 2015 के तहत ग्राह्य नहीं है। अिभयुक्त की exact जन्मितिथ का कोई आधार प्रस्तुत नही िकया गया। प्राथर्नापत्र को प्रस्तुत िकये गये दस्तावेज से बल नही िमलता। प्राथर्नापत्र पोषणीय नही है व िनरस्त होने योग्य है।

प्राथीर्/अिभयुक्त की ओर से प्रस्तुत प्राथर्नापत्र वास्ते घोिषत िकये जाने िकशोर अपचारी िनरस्त िकया जाता है।"

(x) Thereafter, another application dated 03.03.2023 was also moved by

the accused/revisionist praying therein for ossification test.

¶37

(xi) The order dated 28.02.2023 passed by the trial court was challenged before this Court by means of Criminal Revision No. 242 of 2023 (Dilshad Ahmad vs. State of U.P. and another) and this Court vide order dated 17.03.2023 after considering the relevant provisions interfered in the order passed by the trial court. The order dated 17.03.2023 reads as under:-

"Heard learned counsel for the revisionist, Shri Vijay Prakash Dwivedi, learned AGA for the State and perused the material available on record.

The instant Criminal Revision under Section 102 of the Juvenile Justice (Care & Protection of Children) Act, 2015 has been filed against the judgment and order dated 28.2.2023 passed by the learned Additional Sessions Judge/Special Judge (POCSO Act), Sultanpur in Special Sessions Trial No. 537 of 2018 arising out of case crime No. 423 of 2017, U/s 354(B) IPC and Section 17/18 of Protection of Children from Sexual Offence Act, 2012, Police Station- Lambhua, District- Sultanpur, whereby the application for declaring the revisionist as juvenile in conflict with law has been rejected.

Learned counsel for the revisionist submits that the revisionist preferred an application for declaring his juvenility before the trial court U/s 9 of Juvenile Justice (Care & Protection of Children) Act, 2015 (in short "the Act, 2015"). The trial court recorded the findings that the family register issued by the Panchayat is not admitted as a proof of age under the provision of section 94 of the Act, 2015, which is contrary to the view held by the Apex Court. But the said application of the revisionist was rejected by the learned trial court without appreciating the evidence available on record and without observing the procedure as prescribed U/s 9 and 94 of the Act, 2015 on 28.2.2023. The said sections 9 and 94 of the Act, 2015 read as under:

"9. Procedure to be followed by a Magistrate who has not been empowered under this Act.- (1) When a Magistrate, not empowered to exercise the powers of the Board under this Act is of the opinion that the person alleged to have committed the offence and brought before him is a child, he shall, without any delay, record such opinion and forward the child immediately along with the record of such proceedings to the Board having jurisdiction.

(2) In case a person alleged to have committed an offence claims before a court other than a Board, that the person is a child or was a child on the date of commission of the offence, or if the court itself is of the opinion that the person was a child on the date of commission of the offence, the said court shall make an inquiry, take such evidence as may be necessary (but not an affidavit) to determine the age of such person, and shall record a finding on the matter, stating the age of the person as nearly as may be:

Provided that such a claim may be raised before any court and it shall be recognised at any stage, even after final disposal of the case, and such a claim shall be determined in accordance with the provisions contained in this Act and the rules made thereunder even if the person has ceased to be a child on or before the date of commencement of this Act.

(3) If the court finds that a person has committed an offence and was a child on the date of commission of such offence, it shall forward the child to the Board for passing

appropriate orders and the sentence, if any, passed by the court shall be deemed to have no effect.

(4) In case a person under this section is required to be kept in protective custody, while the person's claim of being a child is being inquired into, such person may be placed, in the intervening period in a place of safety.

94. Presumption and determination of age.- (1) Where, it is obvious to the Committee or the Board, based on the appearance of the person brought before it under any of the provisions of this Act (other than for the purpose of giving evidence) that the said person is a child, the Committee or the Board shall record such observation stating the age of the child as nearly as may be and proceed with the inquiry under section 14 or section 36, as the case may be, without waiting for further confirmation of the age.

(2) In case, the Committee or the Board has reasonable grounds for doubt regarding whether the person brought before it is a child or not, the Committee or the Board, as the case may be, shall undertake the process of age determination, by seeking evidence by obtaining --

¶51

(i) the date of birth certificate from the school, or the matriculation or equivalent certificate from the concerned examination Board, if available; and in the absence thereof;

(ii) the birth certificate given by a corporation or a municipal authority or a panchayat;

¶53

(iii) and only in the absence of (i) and (ii) above, age shall be determined by an ossification test or any other latest medical age determination test conducted on the orders of the Committee or the Board:

Provided such age determination test conducted on the order of the Committee or the Board shall be completed within fifteen days from the date of such order.

(3) The age recorded by the Committee or the Board to be the age of person so brought before it shall, for the purpose of this Act, be deemed to be the true age of that person."

The further submission the counsel for the revisionist is that without proper inquiry and without application of judicial mind, the trial court rejected the aforesaid application of the revisionist in a cursory manner on the same day i.e. on 28.2.2023 without conducting any inquiry under the Act, 2015.

Learned counsel for the revisionist submitted that in section 94 of the Act, 2015, it is clearly provided that first preference should be given to the date of birth certificate issued from the school or the matriculation or equivalent certificate issued from the concerned board. But the counsel submitted that the revisionist is illiterate and he never got admitted in any school and thus, his birth certificate issued from the board is not available. It is further submitted that as per section 94(ii) of the Act, 2015, birth certificate issued by the Panchayat shall be considered. But the learned trial court rejected the birth certificate of the revisionist issued by the Panchayat in a cursory manner without passing any appropriate order. It is also submitted that learned trial court in the judgement mentioned that in 313 CrPC statement, the revisionist himself stated that he was about 20-21 years. The matter pertains to year 2017, which itself shows that six years ago, the age of the revisionist was less than 18 years. Moreover, in

pariwar register issued by the Gram Panchayat, the date of birth of the revisionist is 2001. The counsel further submitted that juvenility can be claimed at any stage even pendency of the appeal.

Learned AGA vehemently opposed and submitted that the trial court rejected the application of the revisionist after applying judicial mind. Thus, the impugned order passed by the trial court is not liable to be quashed.

Considering the entire facts and circumstances of the case, learned trial court is directed to decide the application to claim the juvenility of the revisionist within one month as per sections 9 and 94 of the Act, 2015. Till determination of claim of the juvenility, no final order shall be passed. The impugned order dated 28.2.2023 passed by the trial court is hereby quashed.

Accordingly, the instant revision is hereby allowed.

Let this order be communicated to the court concerned for necessary compliance."

(xii) After the order dated 17.03.2023, quoted above, passed by this Court, the claim of the accused/revisionist was taken up by the Juvenile Justice Board, Sultanpur (in short "JJB") and vide order dated 11.07.2023, the JJB rejected the claim of the accused/revisionist.

(xiii) The order dated 11.07.2023 passed by JJB, being aggrieved, was impeached by the accused/revisionist by means of Criminal Appeal No. 107 of 2023 (Dilshad Ahmad vs. State of U.P. and another). This appeal was dismissed by the Additional Sessions Judge/Special Judge, POCSO Act, Court No. 13, Sultanpur (in short "Appellate Court") vide order dated 12.12.2023 and affirmed the order dated 11.07.2023 passed by JJB. The relevant portion of the order dated 12.12.2023 is extracted hereunder:-

"मैंने उभयपक्षों को सुना तथा िकशोर न्याय बोडर् के प्रश्नगत आदेश िदनांिकत 11.07.2023 तथा तलबशुदा पत्रावली का अवलोकन िकया।

मूल पत्रवाली के अवलोकन से स्पष्ट है िक प्रधान मिजस्ट्रेट/िकशोर ब्याय बोडर् सुलतानपुर द्वारा आलोच्य आदेश से अपीलाथीर् िदलशाद की संरिक्षका माता की ओर से अपीलाथीर् को िकशोर घोिषत िकये जाने के सम्बन्ध में िदया गया प्राथर्ना पत्र िनरस्त कर िदया गया है।

प्रस्तुत मामले की प्रथम सूचना िरपोटर् के अनुसार वादी मुकदमा महमूद अहमद द्वारा िदनांक 05.12.2017 को इस आशय की तहरीर दी गयी िक उसकी पुत्री पीिड़ता सुबह लगभग 06 बजे सण्डास के िलए बाहर जा रही थी िक पहले से घात लगाकर बैठे िदलशाद अहमद ने उसकी पुत्री के साथ जबरदस्ती बलात्कार करने की कोिशश िकया और उसके शरीर के कपड़े भी फाड़ डाले और कुछ लड़िकयों के बाहर जाते समय उसकी पुत्री पीिड़ता ने गोहार िकया तो गोहर की आवाज सुनकर िदलशाद ने कहा िक यिद िकसी से बताओगी तो जान से मार डालने की धमकी देते हुए भाग गया, तब उसकी जान बची। उसकी पुत्री पीिड़ता की उम्र लगभग 15 वषर् है।

िकशोर न्याय बोडर् के आलोच्य आदेश िदनांिकत 11.07.2023 के अवलोकन से िविदत है िक धारा-94 िकशोर न्याय (बालकों की देख रेख व संरक्षण) अिधिनयम 2015 के तहत किथत अपचारी की जन्मितिथ के शैक्षिणक अिभलेख किथत मदरसे से जारी अंक तािलका के आधार पर घटना की ितिथ 04.12.2017 को किथत अपचारी की उम्र 20 वषर् 04 माह 02 िदन पाते हुए प्राथर्नापत्र बावत घोिषत िकये जाने िकशोर खािरज िकया है ।अपीलाथीर् द्वारा अपनी अपील में यह कहा गया है िक अपचारी उक्त मदरसे का छात्र नहीं रहा है। िकशोर न्याय बोडर्, 02 , सुलतानपुर के समक्ष परीिक्षत साक्षी सी०डब्लू० अब्दल हफीज जो मदसा अशरिफया फलाहु ुल मुिस्लमीन

2019 लम्भुआ का प्रधानाध्यापक द्वारा सशपथ बयान िदया गया है िक वह सन् से प्रधानाध्यापक के पद पर 01.07.13 -09 काय र ् त है। अपचारी िदलशाद अहमद का दािखला उनके मदरसों में िदनांक को कक्षा में प्रवेशांक सं० 491 02.08.1997 पर अंिकत है। िपता का नाम मोबीन अहमद माता का नाम रईसा बेगम तथा जन्मितिथ 2015 अंिकत है। िदलशाद ने हाईस्कूल की परीक्षा में उत्तीणर् िकया। उक्त साक्षी ने अपचारी की एस०आर० रिजस्टर - 1 डाला गया। सी0 2 को मूल से िमलान करके प्रमािणत िकया है िजस पर प्रदशर् सी० डब्लू के रूप में परीिक्षत , अब्दुल हफीज प्रधानाध्यापक मदरसा अशरिफया फलाहुल मुस्लेमीन लम्भुआ बाजार से बयान िदया है िक 01.07.2013 09 491 पर िपता िदलशाद अहमद का दािखला हमार मदरसे े में िदनांक को कक्षा में प्रवेशांक संख्या 02.08.1997 का नाम मोबीन अहमद माता का नाम रईसा बेगम तथा जन्मितिथ अंिकत है। िदलशाद ने हाईस्कूल 2015 02 की परीक्षा को उत्तीणर् िकया। साक्षी सी०डब्ल ने अपचारी के माकर् शीट की छायाप्रित एस०आर० रिजस्टर -1 डाला गया। से िमलान करके प्रमािणत िकया है। िजस पर प्रदशर् सी उक्त साक्षी से सहायक अिभयोजन अिधकारी द्वारा िजरह की गयी तथा बचाव पक्ष के अिधवक्ता द्वारा की गयी िजरह में साक्षी ने बयान िदया है िक पत्रावली में आधार काडर् के िहसाब से िदलशाद की जन्मितिथ 08.09.2001 अंिकत है। कक्षा में प्रवेश करते समय छात्र का प्रवेश फामर् भराया जाता है िजसमें छात्र का हस्ताक्षर एवं िपता का हस्ताक्षर होता है तथा जन्मितिथ िलखी होती है, ऐसा कोई फामर् िदलशाद का साक्षी के पास उपलब्ध नहीं है। मुंशी कक्षा में जो दािखल खािरज रिजस्टर साक्षी लाया है उसमें जो जन्मितिथ िलखी गयी है,िकस आधार पर िलखी गयी है कोई प्रमाणपत्र उपलब्ध नहीं है। इसके रिजस्टर में िदलशाद का प्रवेश 01.07.2013 से 01.07.2014 तक िदखाया गया है जो मुंशी का है। िदलशाद की टी०सी० व कोई प्रमाण पत्र उपलब्ध नहीं है। पत्रावली में िदलशाद के मुंशी कक्षा की छायाप्रित दािखल की गयी है उस पर िकस प्रधानाचायर् के हस्ताक्षर है, वह नहीं बता सकता। उसके आगे बयान िदया िक उसके स्कूल की मान्यता 16.05.2020 से 05 वषर् के िलए 1100 रूपये/-देकर 16.06.2020 को िमली है। िदलशाद को वह जानता पहचानता नहीं है।

बचावपक्ष की ओर से सी0डब्लू 02 से की गयी िजरह में ऐसा कोई तथ्य नहीं लाया जा सका है, िजससे यह सािबत 0 हो िक अपचारी उक्त मदरसे का छात्र नहीं रहा है। जो भी िजरह बचावपक्ष की ओर से की गयी है वह या तो सी 02 डब्लू द्वारा लाये गये एस०आर० रिजस्टर को िनयमानुसार अनुरिक्षत ना करना व अन्य औपचािरक प्रपत्र जो , 02 से छात्र के दािखले के समय िवद्यालय द्वारा मांगा जाना अपेिक्षत ह के सम्बन्ध में है। बचावपक्ष द्वारा सी०डब्लू 02 ऐसा कोई प्रश्न नही िकया गया िक अपचारी उकं ्त मदरसे का छात्र कभी नहीं रहा था जबिक सी०डब्लू ने स्पष्ट रूप से अपनी िजरह बयान में बताया है िक उनके मदरसे के रिजस्टर में अपचारी िदलशाद का प्रवेश िदनांक 01.07.13 से 01.07.14 तक िदखाया गया है जो मुंशी कक्षा का है। सी०डब्लू ०२ ने यह भी स्पष्ट िकया है िक उक्त िवद्यालय मान्यता प्राप्त है। इस प्रकार अपचारी की आय सु े सम्बिन्धत जो भी साक्ष्य िकशोर न्याय बोडर् के , समक्ष प्रस्तुत िकये गये है वह अपचारी के शैक्षिणक अिभलेख ह िजनक खे ण्डन में बचावपक्ष की ओर से कोई अिभलेखीय साक्ष्य प्रस्तुत नही िकया गया हं ।ै

5 अपचारी की आयु के सम्बन्ध में सूची क से अपचारी के आधार काडर् व पिरवार रिजस्टर की फोटो प्रित दािखल की गयी है।

िकशोर न्याय (बालकों की देख रेख व संरक्षण) अिधिनयम 2015 धारा-94 के अनुसार आयु के िनधा र ्ण में ग्रहण िकये जाने वाले साक्ष्य-(1) प्रथम वरीयता क्रम पर-

(1) िवद्यालय से प्राप्त जन्म तारीख प्रमाण-पत्र, या

¶78

(2) िकसी भी बोडर् का मैिट्रकुलेशन या समतुल्य प्रमाण-पत्र

(2) स्कूल सिटिफकेट या बोडर् की माकर्शीट के अभाव में-

(1) नगर िनगम द्वारा िदया गया जन्म प्रमाण-पत्र,

(2) नगर पािलका द्वारा िदया गया जन्म प्रमाण-पत्र,

(3) पंचायत द्वारा िदया गया जन्म प्रमाण-पत्र

(3) स्कूल सिटिफकेट/सम्बिन्धत बोडर् की माकर्शीट/नगर िनगम/नगर पािलका/पंचायत के जन्म प्रमाणपत्र के

अभाव में :-

(1) ओसीिफकेशन जांच,

(2) आयु िनधा र ्ण से सम्बिन्धत कोई भी नवीनतम िचिकत्सीय प्रणाली,

इस प्रकार धारा-94 िकशोर न्याय (बालकों की देख रेख व संरक्षण) अिधिनयम 2015 में वरीयता के क्रम में पहले शैक्षिणक अिभलेख पर िवचार िकया जायेगा उसके बाद ही अन्य अिभलेखों को िवचार में िलया जायेगा। अपीलाथीर् द्वारा प्रस्तुत शैक्षिणक अिभलेख के खण्डन में कोई अिभलेखीय साक्ष्य प्रस्तुत नहीं िकया गया है तथा सी०डब्लू 02 से िजरह में सह बात भी नहीं लायी गयी है िक अपचारी किथत मदरसे का छात्र नहीं रहा है।

अपीलाथीर् की ओर से अपने अपील के समथर्न में दी गयी िविध व्यवस्थायें प्रस्तुत मामले के तथ्यों पर लागू नहीं होती है।

ऐसी दशा में मामले के तथ्य एवं पिरिस्थितयों एवं िकये गये िववेचन से यह स्पष्ट होता है िक िवद्वान िकशोर न्याय बोडर्, सुलतानपुर द्वारा पािरत आदेश िदनांिकत 11.07.2023 आदेश िविध सम्मत ढंग से पािरत िकया गया है, अवर न्यायालय द्वारा पािरत आदेश में कोई तथ्यात्मक अथवा िविधक त्रुिट होना पिरलिक्षत नहीं होता है। िजसमें हस्तक्षेप िकये जाने की कोई आवश्यकता नहीं है। अपीलाथीर् की अपील बलहीन होने के कारण, िवद्वान िकशोर न्याय बोडर्, सुलतानपुर द्वारा पािरत आदेश िदनांिकत 11.07.2023 पुष्ट करते हुए प्रस्तुत अपील िनरस्त होने योग्य है।

दािण्डक अपील उपरोक्तानुसार िनरस्त की जाती है। िवद्वान िकशोर न्याय बोडर् सुलतानपुर द्वारा आदेश िदनांिकत 11.07.2023 आदेश पुष्ट िकया जाता है।

आदेश की प्रित के साथ िवशेष सत्र परीक्षण सं० 537/2018 राज्य बनाम िदलशाद की पत्रावली िव० न्यायाधीश पॉक्सो ऐक्ट कक्ष सं० 12, सुलतानपुर को िनयमानुसार अिवलम्ब वापस भेजी जाये।"

In the aforesaid background of the case, the instant revision has been filed before this Court.

The challenge to the impugned orders dated 11.07.2023 and 12.12.2023 has been made by the revisionist on the ground that as per Section 94 of J.J. Act, 2015, the Pariwar Register ought to have been considered for declaring the accused/revisionist as juvenile and in ignoring the same the JJB and also the Appellate Court committed error of fact and law both.

It is also stated that the JJB and also the Appellate Court committed error of fact and law both in considering the mark sheet of Munshi Examination-2015 issued by U.P. Board of Madarsa Education, Lucknow, as per which the accused/revisionist was born on 02.08.1997 as the photocopy of the said mark sheet was submitted by the prosecution.

On the contrary, the side opposite stated that the impugned orders dated 11.07.2023 and 12.12.2023 are not liable to be interfered with by this Court in exercise of revisional jurisdiction. It is for the reason that the copy of Pariwar Register was not proved by the accused/revisionist as per law.

In continuation, it is stated that to establish/prove the documentary evidence i.e. copy of Pariwar Register, if it is presumed that the same was

a certified copy, though it was only a photocopy, even then the accused/revisionist was under obligation to call upon the ADO (Panchayat) alongwith original Register, which has not been done in the instant case.

It is also stated that the aforesaid is also for the reason that the Munshi Certificate was proved by Abdul Hafeez (CW-2), Principal of the School/Madarsa concerned and it is not in dispute that the Munshi Certificate is equivalent to High School Certificate.

Considered the aforesaid and also perused the record.

Upon due consideration of the aforesaid, this Court finds no force in the instant revision. It is for the following reasons:-

(i) The photocopy of the Pariwar Register, as per which, the accused/revisionist was born on 08.09.2001, was not proved by the accused/revisionist as per law.

(ii) The Munshi Certificate, as per which the accused/revisionist was born on 02.08.1997, was proved by Abdul Hafeez (CW-2), Principal of the School/Madarsa concerned and it is not in dispute that the Munshi Certificate is equivalent to High School Certificate. Therefore, in considering the date of birth indicated in the Munshi Certificate i.e. 02.08.1997 as correct dated of birth in terms of Section 94 of the Act of 2015, the JJB and also the Appellate Court have not committed any error.

For the foregoing reasons, the instant revision is dismissed .
