Heard Sri Ram Mani Upadhyay, learned counsel for the revisionist and Sri Pankaj Kumar, learned A.G.A. for the State.

Learned counsel for the revisionist submits that the instant criminal revision has been preferred with the relief which has been mentioned in the prayer clause. The relief mentioned in the prayer clause of the revision is delineated below:-

"It is therefore most respectfully prayed that, this Hon'ble Court may graciously be pleased to quash the order dated 10.03.2026 passed by the Additional Principal Judge, Family Court, Court no.2, Aligarh in Case No.679 of 2019 (Smt. Dr. Faijiya Khan and another Vs. Dr. Mohammad Shadab) allowing the application under section 125 Criminal Procedure Code filed by the respondent no.2 & 3 in Case No.679/2019, whereby the application under Section 125 criminal procedure code filed by the respondents for maintenance has been partly allowed and the revisionist has been directed to pay Rs.20,000/- per month to the minor daughter (respondent no.3).

It is, further prayed that this Hon'ble Court may graciously be pleased to stay the effect and operation of the order dated 10.03.2026 passed by the Additional Principal Judge, Family Court, Court no.2, Aligarh in Case No.679 of 2019 (Smt. Dr. Faijiya Khan and another Vs. Dr. Mohammad Shadab) allowing the application under section 125 Criminal Procedure Code filed by the respondent no.2 & 3 in Case No.679/2019, whereby the application under Section 125 criminal procedure code Filed by the

respondents for maintenance has been partly allowed and the revisionist has been directed to pay Rs.20,000/- per month to the minor daughter (respondent no.3).

And/or may pass any other or further order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned counsel for the revisionist submits that by impugned order dated 10.03.2026, the Additional Principal Judge, Family Court, Court No.2, Aligarh has granted Rs.20,000/- maintenance amount to the minor daughter of the revisionist/O.P. No.3 from the date of application i.e.01.06.2019. He further submits that the revisionist is ready to clear all the dues regarding arrears of the maintenance amount as well as he is ready to pay the maintenance amount regularly on monthly basis. He further submits that the revisionist is ready to pay Rs.4 lakh at once towards the arrears of maintenance amount and prays that for the rest of the arrears of maintenance amount, this Court may fix some easy installment.

In view of aforesaid facts and circumstances of the case and submission of learned counsel for the revisionist, the revisionist is directed to pay Rs.4 lakh in the account of the Additional Principal Judge, Family Court, Court No.2, Aligarh within fifteen days from the date of this order. Upon deposit of the aforesaid amount by the revisionist within stipulated time, the Additional Principal Judge, Family Court, Court No.2, Aligarh shall fix 24 equal monthly installments in respect of the rest arrears of the maintenance amount, which shall be deposited by the revisionist by the 10th of every month starting from June, 2026 upto May, 2028 in the account of O.P. No.3 or O.P. No.2. In addition to this, the revisionist shall continue to pay the maintenance amount to O.P. No.3 in terms of order dated 10.03.2026. It is further directed that as soon as the amount of Rs.4 lakh is deposited in the account of the Additional Principal Judge, Family Court, Court No.2, Aligarh, it shall be immediately given to the minor daughter of the revisionist/O.P. No.3 in the guardianship of her mother/O.P. No.2 by the concerned Family Court.

In case the revisionist commits any default in compliance of this order, the Additional Principal Judge, Family Court, Court No.2, Aligarh,

will be at liberty to proceed for recovery of the arrears of maintenance amount from the revisionist in terms of order dated 10.03.2026, and simple bank interest @ 6 % shall be applied on the arrears of the maintenance amount.

With the aforesaid directions, the instant revision is disposed of.
