Heard learned counsel for the revisionist and learned counsel for opposite party no. 2.

Learned counsel for both parties duly submitted that the parties have entered into a compromise and all disputes have been finally settled. The amount in dispute has already been paid and received.

An affidavit of consent filed by the complainant/opposite party no. 2 is on record. In paragraph no. 5 thereof, it has been stated that a compromise was entered into between the revisionist and the deponent/opposite party no. 2, and in terms of the compromise, a sum of Rs. 4,00,000/- was paid by the revisionist to the deponent/opposite party no. 2 by way of demand draft dated 27.10.2025. The said amount has been accepted by the deponent/opposite party no. 2. It has also been stated that the deponent has no objection if the conviction order dated 04.03.2024 and the appellate order dated 05.12.2024 are quashed by this Court.

Learned counsel for the parties agree to the same. The matter has been amicably settled between the parties, and as per Section 147 of the Negotiable Instruments Act, 1881 (N.I. Act), the offence is compoundable. Section 147 of the N.I. Act is quoted hereinbelow:

“ 147. Offences to be compoundable .—Notwithstanding anything contained in the Code of Criminal Procedure, 1973 (2 of 1974), every offence punishable under this Act shall be compoundable.”

In view of the compromise entered into between the parties, the matter is compounded in terms of Section 147 of the N.I. Act.

Accordingly, the impugned order dated 04.03.2024 and the appellate order dated 05.12.2024 are hereby set aside, and the present criminal revision is finally decided in terms of Section 147 of the N.I. Act.

The criminal revision is disposed of accordingly.
