Heard learned counsel for the revisionists and the learned AGA for the State.

The present criminal revision has been preferred challenging the impugned order dated 15.12.2025, passed by the learned Additional District and Sessions Judge/Special Judge, (Prevention of Corruption Act), Special Judge, Court No.1, Varanasi in Session Trial No. 490 of 2023 (State Vs. Shri Kishun and others), arising out of case crime N o. 67 of 1999, under Section 324, 323, 504, 307/34 IPC, P.S. Chaubepur, District Varanasi, whereby discharge application of the revisionists has been rejected.

Learned counsel for the revisionists has submitted that there is dispute of land. There is no injury report in the C.D.The modification took place after forteen years. The case is pending since 1999. The revisionists have been summoned under Section 307/34 IPC. PW-1/complainant/injured has deposed before the court that the accused persons had caused fatal injury on his head. CT scan, medical report dated 19.4.1999, X-ray plate and one x-ray, one discharge slip and medical report has been filed. The report of CT scan shows bony cut show depressed fracture in right frontotemporo parietal region.

4.The genesis of crime began in the year 1999 vide case crime No. 67 of 1999. The matter has to be settled on merit as expeditiously as possible. There is prima facie evidence available. Neither any meticulous

observation nor mini trial is permissible at this stage. The prosecution has to prove its case beyond reasonable doubt against the accused persons. The final appreciation of evidence could be done and conducted by the learned trial court at the end of the trial.

In view thereof, there is no illegality or irregularity in the impugned order. The present criminal revision is hereby dismissed , whereas the learned trial court is directed to decide the present case on priority basis as expeditiously as possible.
