Heard Mr. Ramesh Kumar Mishra, the learned counsel for petitioner and the learned A.G.A. representing State-respondents 1, 2 & 3.

Petitioner- Ram Kumar Maurya has approached this Court by means of present criminal misc. writ petition for a writ of mandamus commanding respondents to conduct fair investigation of Case Crime No. 0508 of 2020, under Sections 147, 323, 504, 506, 308, 392 of IPC, P.S.- Mau Aima, District- Prayagraj, arising out of the FIR dated 21.07.2020 lodged by first informant- Ram Kumar Maurya i.e. the writ petitioner.

On the matter being taken up, the learned A.G.A. representing Staterespondents 1, 2 & 3 submits that during pendency of present criminal misc. writ petition, Investigating Officer, upon completion of statutory investigation of aforementioned case crime number in terms of Chapter-XII CrPC, has already forwarded the final report/police report dated 04.05.2026 in terms of Section 173(2) CrPC. Learned AGA, therefore, submits that in view of above, no cause of action now survives with petitioner to maintain the present writ petition. As such, the present writ petition is liable to be dismissed as having rendered infructuous.

When confronted with above, the learned counsel for petitioner could not overcome the same.

Having heard, the learned counsel for petitioner, the learned A.G.A. representing State-respondents 1, 2 & 3, upon perusal of record and considering the submissions urged by the learned AGA in opposition to present writ petition as noted above, we find that since the final report/police report dated 04.05.2026 has already been forwarded, therefore, no cause of action now survives with the petitioner to maintain the present writ petition. As a result, the present writ petition is liable to be dismissed as having rendered infructuous.

It is, accordingly, dismissed as having rendered infructuous .
