This writ petition has been filed seeking to quash the first information report dated 17.12.2025 giving rise to Case Crime No.713 of 2025, under Section 137(2) of B.N.S., Police Station Hata, District Kushinagar.

A very crucial dispute has arisen in this matter as to whether Sadanan Singh son of Prem Singh, who is also known as Lakkha, is known as Ajai as well. The prosecutrix, who is minor, in her statement under Section 183 of BNSS has stated that she knew Ajai since the time period of one year. On 16.12.2025, Ajai called her over telephone and took her along to Mumbai. The two stayed in Mumbai for 12-13 days. It is also admitted in her statement under Section 183 BNSS that the prosecutrix and Ajai stayed together as man and wife and married in a temple.

Mr. Shashi Shekhar Tiwari, learned A.G.A. states, without any material to substantiate so far available in the case diary, that Sadanan Singh alias Lakkha is the same man as Ajai. He has drawn our attention to C.D. No. 11, where Sadanan alias Lakkha alias Ajai son of Prem Singh figures, in whatever the Investigating Officer has recorded on that day. There is absolutely no basis to the statement recorded in the C.D. that Sadanan Singh alias Lakkha has a second alias Ajai.

Learned counsel for the petitioner disputes this fact.

Let the prosecutrix be produced before this Court on 02.04.2026 at 02:00 p.m. On the said date, the petitioner Sadanan Singh will also appear in
