1. Heard Mr. Vinod Kumar Sharma, the learned counsel for

petitioner and the learned A.G.A. representing State
respondents1,2&3.

2. Perused the record.

3. Petitioner, Sunil Kumar Chaurasia, who is also the first
informant, has approached this Court by means of present
Criminal Misc. Writ Petition for a writ of mandamus
commanding respondents 2&3 to conclude fair investigation
of Case Crime No. 57 of 2020, under Sections 419, 420, 467,
468, 471, 506 I.P.C., Police Station Kotwali, District
Gorakhpur arising out of the FIR dated 07.03.2020 lodged by
the first informant/petitioner.

4. Considering the fact that a period of almost six years
has expired from the date of lodging of the impugned FIR
but the requisite Police report has not been submitted, we,
therefore, direct the learned A.G.A. to obtain specific

instructions in the matter as to why after expiry of almost
six years from the date of lodging the impugned FIR, the
requisite police report has not yet been submitted in the
matter.

5. Put up again for admission as fresh on 20.02.2026.

Till date, there are neither instructions nor affidavit filed on behalf of the State to indicate what steps have been taken as regards investigation in Case Crime No. 57 of 2020, under Sections 419, 420, 467, 468, 471 and 506 of the Indian Penal Code, 1860, Police Station Kotwali, District Gorakhpur.

Let the Senior Superintendent of Police, Gorakhpur file his affidavit, within a week, indicating the status of investigation in the present crime.

Adjourned to 21.04.2026 .

To be taken up as fresh .

The Registrar (Compliance) is directed to communicate this order to the Senior Superintendent of Police, Gorakhpur through the learned Chief Judicial Magistrate, Gorakhpur within 48 hours next .
